Although the wreck which killed eight people and injured more than 200 was caused by train operator Brandon Bostian going more than twice the speed limit, on May 9, 2017 prosecutors said he would not face any criminal charges because there was no evidence that Bostian had acted with criminal intent.[76] On May 12, 2017, Philadelphia Municipal Court Judge Marsha Neifield ordered prosecutors to file involuntary manslaughter and reckless endangerment charges against Bostian; the district attorney referred the matter to the Pennsylvania Attorney General.[77]
