Salt Lake City Mayor Jackie Biskupski announced that as a result of the criminal investigation being launched by the Salt Lake County District Attorney, Detective Jeff Payne will be placed on full administrative leave with pay.
Later Friday night, police stated two employees are on administrative leave. It was not immediately clear who the second employee is.

Yep, but the detective has further “CYA”: he also says he was trying to help the innocent victim truck driver by establishing a “no-blood alcohol/drugs” “chain of evidence” by doing the blood test. (Prevent a lawsuit by the chase perp’s lawyer against the trucking company). Weak, I know.
I will also be interested in the criminal side of this investigation. Will Officer Payne spend time in prison?

But, just as a point of correction, a citizen cannot refuse to comply with LE. They tell you to get out of the car and they have no good reason, get ready to be tased. And, perp or victim, the police can arrest anyone they want. It may turn out to have been an illegal arrest, but until it is decided by a court, they can do everything required to effectuate the arrest up to and including doing bodily harm.
It is my understanding the laws about blood draws apply to the driver not the medical professionals. The agreement only allowed for the conditions listed. I think there are a lot of legal issues here for lawyers to quibble over. The nurse followed hospital policy and laws concerning patient care and rights.
Never tell the following people what “they are going to do”. The pizza guy, doctors, nurses, waitresses or waiters, the testaraunt chef, or the counter people at McDonalds. Your arrogance will have consequences.
Suppose a cop orders a strip search for drugs on one of your female relatives in full public view.
Does she have to comply?
That’s the point “they” were chasing. If they could pin wreckless driving or drunk driving on the truck driver who was unconscious, the two cops might not be in so much trouble.

If the LEO is ordering the citizen to do something illegal - to commit a felony - then the citizen not only can refuse, he must refuse.
Then, as you say, the cop might take aggressive physical action against the citizen. But at that point the cop is no longer a cop. He’s a gangster, badge or not.
Yeah, you’d think this never happened before or something...(perhaps it was the first time in a long time that the police wanted a blood draw on an “apparently innocent guy”). If the police suspected drunk/impaired driving and “exigent circumstances” are going to happen due to the administration of pain killers or a saline drip to the patient I think the hospital would be required to allow a blood draw....wonder how often it happens...not too much I would imagine.
There was a case here where LE took a prisoner to a hospital for a medical exam to look for drugs. The hospital refused so LE took him to another hospital that complied, no drugs were found with xray or exam. LE told hospital to do colonoscopy...LE were in the wrong...big lawsuit won against County

The hospital has a policy and a written agreement with the police agency for this exact scenario and the cops refused to follow their own agreement. Payne was on the phlebotomy team but doesn’t know the gd agreement he operates under?

The city is now trying to minimize their exposure to a civil rights lawsuit that is sure to be filed. Problem is, the city should not have waited a month and a half to take action; and only did so because of the publicity.

The nurse was following hospital rules and regulations. If she drew the blood, she could be fired and lose her credentials. The cops were in the wrong, and should be fired and sued, if not jailed for assaulting the nurse. Jury will side with the nurse, and convict the ex-cops.
