House defends subpoena for bank records of company behind anti-Trump dossier

The House intelligence committee told a federal judge this week that it issued a broad subpoena for Fusion GPS’ bank records because so much of the investigation relies on classified information, and it can’t divulge details of what it’s looking for specifically.

Fusion, which assembled the 35-page anti-Trump dossier that emerged late in last year’s presidential campaign, has balked at the scope of the subpoena, saying if it knew what the House wanted, it could help narrow the search.

But House General Counsel Thomas G. Hungar told a judge during a phone conference held Tuesday that the committee is investigating matters beyond just the production of dossier and that its investigators must be allowed the freedom to search for all relevant information.

“It would be one thing if the bank could simply tell us everything that is relevant to what the committee needs, which is more than what Fusion seems to think it is. But the problem is the bank isn’t in a position to do that. Only the committee is,” Mr. Hungar said, according to a transcript of a Tuesday’s conference.

The negotiations come as the committee has sought to learn more about the dossier Fusion produced on President Trump amid the 2016 presidential campaign, and how federal investigators relied on the document as part of their own probe of Russian interference in the election.

Interesting.

And it has received very little coverage.

The House is insisting on ALL of Fusion's bank records for mid-2015 until now. The reasons they cite for this very broad request are "classified" and cannot even be divulged to Fusion or the Judge.

Many thought the Judge would decide as early as today...but we could see fireworks over the weekend.

This is more fun than a barrel of monkeys.

It kinda depends on the bank, right?

A very small CIA front bank in the Bahamas could disappear off the planet in hours.

CitiBank has nowhere to go. And far too much at stake.

I just read a Reuters report from a few minutes ago:

Decision on release of Fusion GPS bank records delayed until Monday morning.

My take on this is that the records are going to be released. This a Dem friendly judge who has had all the opportunities she needed to deny the request by the House. But she hasn’t done so and, IMHO, she’s not going to.

Interesting times.

The law is absolutely clear, and inarguable.

The government has a right to any and all financial records whenever they please.

The bank is obligated by law to provide them upon legitimate request. Or cease to be a licensed bank.

Payment(s), cash transfers, etc., could have gone to private individuals’ bank accounts of a variety of people in addition or instead and even in several steps.

That’s what prompted the subpoena.

You are correct of course.

But this judge was always going to bend over backwards to support the Dem side. But she also knows you are right and that any ruling in favor of the Dems would certainly be overturned.

I think she is just giving Fusion GPS a little more time to make a deal with the House Committee. Dem friendly judge. No surprise.

Patience. Congress will have those records soon. And a bit later we should get a peek ourselves.

I think more likely it will show revenue from a variety of Law Enforcement and Intelligence sources, US and Foreign (Russia) and payments to criminals, scam artists and politicians.

But I repeat myself.

This outfit is notorious for producing dirt on politicians and enemies of politicians. Rarely true.

But they have a nearly unique ability to saturate the media with their findings.

Which also leads me to believe they are paying very large media outlets too.

That’s what makes their dirt so dangerous.

I think large media outlets are paying Fusion (read CNN, MSNBC). I assume Fusion reps are some of the anonymous sources but the bank records won’t prove that.

The judge has no legal basis not to uphold the subpoena. So why the delay? Well, it gives the judge’s favored side leverage to demand a narrower scope. This is already a display of judicial corruption. Hopefully the Congressional side sticks to its guns. Appeal all the way to SCOTUS if necessary.
