So if a cop has an 18 year old under arrest and offers to release her on the condition she have sex with him and she agrees, would you consider that consensual?
An agreement like that would have been just one potential reason. As I wrote earlier, she could have simply had a thing for cops, as lots of women do.
Or, as someone above suggested, she could have freely offered with the intention of later claiming rape and then suing for big bucks.
Legally, the 18-year-old status doesn't enter into it, although, IMO, and I'm sure many others', 18-yos are very much still naive kids.
So would you consider it consensual sex in the scenario I described in my previous post, yes or no?

Good - hanging the dirty cops by their balls is one of the best ways to clean it up and instill a sense of trust in the community.
Of course it would be consensual. *IF* your scenario was true, she still had a choice.

The New York Age of Consent is 17 years old. In the United States, the age of consent is the minimum age at which an individual is considered legally old enough to consent to participation in sexual activity.
Individuals aged 16 or younger in New York are not legally able to consent to sexual activity, and such activity may result in prosecution for statutory rape.
Photos online don’t mean she wanted to have nasty sex with two cops in a police van.
So, if a schoolteacher were propositioned by an 18 year old student you’d be fine with that too?
Wasn’t this an episode of Law & Order SVU, or an old Hill Street Blues or NYPD Blue? Sounds awfully familiar!
At that point she may have only been "detained".
So, you're OK with rape, gang rape and rape on duty?
Who the heck said I was 'fine' with what the cops did, regardless of how it transpired? I was addressing the legal vs illegal angle of it. And, as I've shown many times above through repeated posts, but apparently few if any responders are bothering to read it, IF she willingly engaged in sex with them, ie, had consented to sex, it would NOT be a crime, according to the stupid current law. It would be against police policy and it would merely be considered an act of "misconduct". Please go back and read one of my several repeated posts regarding the current law on this.
