The Trump administration moved Friday to claim custody of the illegal immigrant who killed Kate Steinle, saying he violated the terms of his probation and should be sent back to federal prison.

The move is aimed at taking Jose Inez Garcia Zarate away from California officials, after a jury in that state acquitted him Thursday of murder and manslaughter charges stemming from the Steinle killing.

A Justice Department official said there’s an existing federal detainer requiring Garcia Zarate to be remanded to U.S. Marshals and sent to a federal court in Texas to answer for the probation violation.

Garcia Zarate was convicted of a weapons charge but acquitted of murder, manslaughter and assault with a deadly weapon charges from the 2015 killing of Steinle, a 32-year-old who was shot while walking the San Francisco waterfront with her father.

Garcia Zarate admits to shooting her, but says it was a freak accident

I can understand not convicting him of murder. But pulling the trigger of a gun on a crowded city street surely qualifies as involuntary manslaughter, which only requires the death come thru an act a normal person would understand could be dangerous to others.

The pistol he fired requires a 10 lb trigger pull to fire the first shot. No one does that “accidentally” - although in SF, no one on the jury may have ever touched a gun before.

Oh, that means soon we’ll see the loons in SF forming a human shield to protect the murderer.

They intentionally charged him with murder knowing it would never stick and he would go free.

Excellent. They can be arrested too for interfering with U.S. Marshals carrying out the arrest.

You may be right. He’s guilty of negligent homicide, at the very least. The U.S. Marshals need to be on the site quickly, along with the FBI in case the commies try to sneak him out.

There is no time to waste.

Doesn’t San Francisco have some kind of camp for the illegal aliens or a way to ship them to some other country isn’t that what they’ve done before?

>Nice! Will SF let him loose in the middle of the night?

I would say yes. Their behavior on this issue is consistent with giving the rest of the middle finger.

Will SF let him loose in the middle of the night?

I'd say so. Those rats will give him a disguise or will hide him or release 20 other illegals all at one, like flooding the zone.

It will be a cat and mouse game.

Send armed Federal Marshals to take custody.
Send 30 Federal Marshals or more. All armed to the teeth.

Let’s see how much air time this gets. This is one of those rare issues that causes people of all persuasions to soul-search and examine their political philosophy and core principles. You have issues of justice, immigration, sanctuary, double-jeopardy, federalism, guns, parole system and many others all mixed in.

So let me get this straight a felon illegal alien who had stolen a gun from a Federal Officer. He was not supposed to have a gun because he was a felon but he only accidentally fired it once so that relives him of responsibility. That jury should be identified and shamed.

Until the DOJ backs it up with force, the communists will not comply.

Are the Sanctuary Cities obeying Federal law or toothless Jeff Sessions?

I may be wrong, but I a’n’t holding my breath.

He claims it was a freak accident. Did he know the victim? Was he aiming for her for some reason? The details aren’t as straightforward as I thought.

What I read was that he was “playing” around with the gun and it went off. Supposedly the round ricochet before hitting the woman in the chest area.

Involuntary manslaughter would have been the correct verdict.
