ORDER IN PENDING CASE
17A550 TRUMP, PRESIDENT OF U.S., ET AL. V. HAWAII, ET AL.
The application for a stay presented to Justice Kennedy and by
him referred to the Court is granted, and the District Court’s
October 20, 2017 order granting a preliminary injunction is stayed
pending disposition of the Government’s appeal in the United States
Court of Appeals for the Ninth Circuit and disposition of the
Government’s petition for a writ of certiorari, if such writ is
sought.

If a writ of certiorari is sought and the Court denies the
petition, this order shall terminate automatically. If the Court
grants the petition for a writ of certiorari, this order shall
terminate when the Court enters its judgment.
In light of its decision to consider the case on an expedited
basis, we expect that the Court of Appeals will render its decision
with appropriate dispatch.

Justice Ginsburg and Justice Sotomayor would deny the
application.

This is F’n pathetic, isn’t it. A court “allows” the president to exercise his authority on immigration standards, who may or may not enter. In better days, this would have been taken care of publicly.

I don’t think it was ceding his authority. Whoever advised him not to thump that judge on the head made the right decision. With this, it told everybody against it that a judge cannot legally interfere in something he has no authority in in the first place.

You, me, every other FReeper, and everybody else knows that if Trump thumped the judge on the head and told him to go screw himself, that EVERYONE against it would then fervently believe they have some sort of legal case against the president, and a thousand more BS lawsuits would have been started up.

The cards were played right, even though it looked like defeat without putting up a fight. This is unfortunately what he has to do - walk a tightrope or risk an avalanche of lawsuits contesting his authority under the constitution.
