Agreement is test for national detainer authority.
More than a dozen Florida sheriffs announced a deal Wednesday that will allow them to hold illegal immigrants wanted by the federal government for deportation, in whats likely to be a key test case for cities and countries eager to cooperate but worried about legal problems associated with helping the Trump administration.
Known as the Basic Ordering Agreement, the deal struck between 17 Florida sheriffs and U.S. Immigration and Customs Enforcement would allow local authorities to hold illegal immigrants even beyond the time they normally would have to be released based on state or local cases.

It is beyond stupid for local law enforcement not to assist.
Some departments have wanted to for years and were rebuffed by the last 4 Presidents.

I’m impressed with acting director Thomas Homan, don’t know what if any problem there is in confirming him.
That’s mighty white of them to follow the law.
Every federal court to consider the issue has said it is a violation of the Fourth Amendment to hold a person - whether an illegal immigrant or not - in jail after they are otherwise free to leave the jail.
In this context, it is jails holding illegals for ICE. The jails are under no legal or statutory obligation to hold the person unless ICE gets a warrant for further detention.

The poster asked about the legal issues. I responded. If you want to remain ignorant on the subject and/or shoot the messenger, I don't see why I should care.
I guess it just didn’t dawn on you that these people have broken our immigration laws. That is a violation of our criminal codes. Law enforcement is sworn to uphold the laws of our nation.
These people are to be held until deported.

Take it up with the federal courts, troll. They are the problem. I merely told the poster about the legal landscape.
It is. If I were a local sheriff I would screen all new inmates and if they are subject to removal by ICE I would note it in their file.
Upon their release date I would transport them to the nearest ICE office along with any supporting paperwork that ICE might need and drop them off.
There is nothing illegal about it and its not a violation of the aliens rights. Problem solved.
Illegal immigration is a civil law matter, unfortunately.
Yet ICE is free to detain citizens at a POE without a warrant. Why is that?
