Sorry, but that is wrong. The Chief Justice does not have that much power. There has to be 4 votes to hear a case.

I stand corrected (several times) - for some reason I was thinking that he decided what cases the court would hear.
What I was confusing was his job of "setting the agenda", (along with running the roll call vote for each case, and deciding who writes the opinion).

So "setting the agenda" does not mean which cases are to be heard. Learning something new every day....
