The Washington Post reports that Robert Mueller is investigating President Trumps private comments and state of mind during the period when he issued a series of tweets belittling Attorney General Jeff Sessions. According to the Post, the thrust of Muellers inquiry is to determine whether the presidents goal was to oust Sessions in order to pick a replacement who would exercise control over Muellers investigation.
If this story is true, it demonstrates why the nation needs someone in the Justice Department to exercise control over Muellers investigation. It also confirms the suspicion that Mueller is either nuts, desperate to get Trump, or both.
I hated it when Trump went after Sessions on Twitter, a move all-too characteristic of this unpresidential president. But to view the attack as evidence of obstruction of justice strikes me, on first reading, as ridiculous.
For one thing, the president has the right to replace the attorney general if he believes his appointee isnt performing well in any aspect of his job, including the overseeing of an investigation that involves the president. I dont see how the exercise of this power can be the basis for, or evidence of, obstruction of justice. The remedy for misuse of the power is, as Andy McCarthy has often argued, impeachment, not a charge of obstruction.
Since Trump didnt sack Sessions and the attorney general didnt resign, we dont know who would have replaced him or how his replacement would have acted. Thus, we dont know what the effect, if any, of a Sessions resignation would have been on Muellers investigation. Would the new AG have obstructed Mueller? One can only speculate. Building an obstruction of justice claim on such speculation seems crazy, desperate, or both.

At the time he was nominated, nobody thought Jeff Sessions was anything other than a stellar choice. Liberals were incredulous!
Nobody saw coming the disaster he has turned in to. And to add insult to injury, it cost us perhaps the safest Senate seat we had.
Could you imagine Eric Holder recusing himself and allowing a special counsel made up of partisan GOP lawyers to investigate President Obama over a completely baseless non-crime while a Democratic majority congress stood by silently and shrugged their shoulders?
Never in a million years!
The election of Donald Trump presented us with perhaps the greatest opportunity to roll back decades of entrenched liberalism. Instead, we're mired in this Russia BS. And yesterday gun control was on the table! Seriously, WTF?!?!?
I couldn't be more disgusted.
I think Hillary and the dims want the Mueller investigation to keep going, even if they find nothing, as long as its open it gives the dems something to hope for and yak yak about in the MSM. And I think its possible that while Mueller is “investigating Trump” he is really erasing evidence on Hillary and himself.
Shut it down. He’s found nothing but still wasting taxpayer dollars.
Why?
Is there some reason the President of the United States can't simply replace Sessions?
It’s called the Advice and Consent Clause of the Constitution.
That would be very unwise politically. Especially with mid-terms coming up.
Yes. The Senate won't confirm his replacement.
It appears Mueller has figured out that with Session gone, his ass is toast. Unemployment line and then fries guy at McDonalds.
What is the mental state of Mueller? Is he nuts?
Only until such time as the President appoints an interim AG, who can serve a full 270 days. That's plenty of time to fire Mueller and the plotters at DOJ/FBI.

Unwise? Unwise, how?
(R)N(C) haven’t been doing themselves any favors in ‘trying’ to get re-elected in ‘18. What’s the Prez. firing incompetence going to do but IMPROVE the situation (IE: The AG gets in and starts handing out perp-walking papers)?
IMO, keeping the status-quo of not-a-GD-thing-done isn’t a ‘plus’
>>Im furious. Sessions is killing us.
A Trojan Horse couldnt have brought TRUMP more trouble than this useless traitor. He may look like McGoo, but hes caused land mines to be planted under Trump.<<
There are dozens of die-hard Sessions defenders on FR, but lately they all seem to have fallen asleep like their hero.
>> Then its Trumps fault for having Sessions.
Seems that way. He tricked Trump.<<
Sadly, he also tricked quite a few Freepers.
FROM WASHINGTON POST: Fake news designed to discourage and/or divide support for President Trump. Don’t believe it.
>>That they do nothing is a disgrace.<<
Lyin Ryan and the Turtle, puppets of the Deep State.
I am a diehard Sessions fan, although today I am wondering. I finally found my favorite psychic after she was banned from YouTube and all of her videos removed.
She says Sessions is dragging his feet because he is being threatened with blackmail.
He apparently had an affair with his secretary at one time.
She thinks possibly he will come thru - possibly be replaced. Decision is up in the air.
YMMV
