They’ve never been able to do this with guns so now they are trying an indirect approach to acclimate people to accept the “logic” involved.
Blame the alcohol, it works for guns.
I was hit by a drunk driver some 18 years ago. She had just stopped off to buy another six pack. Her BAC was about a two point something. So she was obviously drunk when she bought the six pack.
I got a sharp attorney and we sued the convenience store under the dram shop laws. I did not win though. We could not conclusively prove which convenience store she bought that beer at.
Absolutely outrageous.
Dram Laws are for civil suits-not an arrest.

There was a time in this country when an individual was responsible for himself. It is what made this country unique and fine.
Arresting someone two years after the fact is out and out fascism.

Well, I bloody well do drink! But I make sure that I’m driven home because I don’t want to end up in jail for drunk driving - even if all I’ve had is one white wine in a restaurant. The person who gets drunk and hurts someone is the ONLY one responsible for the crime. Arresting bartenders is disgraceful and completely unAmerican.
Ahhh, so it was after the fact that they watched a security tape from the bar? That makes more sense. Still....

If she was already drunk when she bought the six pack, how is it the fault of the convenience store who sold it to her that she hit you?

We as a society have collectively decided that nobody is at fault for anything. The drunk who hit you isn't at fault. It's the store who sold her beer. The clerk at the store can blame medication for his ADD. And on and on, until we find pockets deep enough to cough up a settlement.
Texas is a bit SCREWED UP regarding alcohol enforcement. A bit less than 10 years ago, they were ARRESTING people in hotel bars for ‘public drunkenness’ even when the people were not causing a problem, or driving, or anything - it was because they simply had ‘too much to drink’ and ‘might’ cause a problem. This included people who had rooms in the damn hotel they were drinking in.

In Texas, all folks who serve alcohol are required to take training in, and pass a test on, recognizing folks who have had too much to drink and the requirement to quit serving them.
If someone was so drunk that they had trouble standing on their own, then yes, she should have cut them off well before that - at least under the Texas rules. I have no idea what the California law is on serving drunks.
Yes, exactly! If they are really going after "everyone involved in the crash" then there's no excuse not to charge them too.
But we all know they're not going to.
Really the responsibility is on the police for getting into a high-speed car chase with a drunk...

Have no doubt that such is the intent.
Just remember, tough law is for little people like us.
Not like swamp dwellers. Their justice system is much more lenient.
I wonder if the bartender can explain she had no “intent” to break the Dram Law?
Youre right. Even though the drunk was at fault, she had no money, no insurance, even the car was not hers. Some convenience store clerk broke the law. But I was not fortunate enough to find which store it was.
So you know who had the deep pockets here? It was my insurance company. Fortunately for me I had good insurance and they paid out big bucks for my pain, suffering and loss.
