ASHINGTON The Justice Department has repeatedly refused to provide former FBI Deputy Director Andrew McCabe with documents related to his firing, according to a lawsuit filed on his behalf Tuesday.
The complaint says the Justice Department has publicly defended the firing yet failed to identify for McCabe the policies and procedures it followed before dismissing him. The department has withheld the information, McCabe's lawyers allege, for fear that the materials could be used against them in any additional lawsuits.
"We don't create or adjudicate under secret law or procedure," David Snyder, one of McCabe's lawyers, said in an email to The Associated Press.
The case pits the career law enforcement official against the Justice Department, where he was employed for more than two decades. It refocuses attention on a firing last March that divided current and former Justice Department officials. And it signals that McCabe, repeatedly targeted for criticism and attacks by President Donald Trump in the last year, is determined to try to clear his name in court even as he faces a possible criminal probe into whether he intentionally misled internal investigators.

It will be interesting to see how fast the DOJ turns over any relevant information - considering their propensity to drag their heels.
This is classic. Break the law and then claim that ‘procedure’ wasn’t followed. Let’s get him before a jury and decide.
I am pretty sure government can fire employees without having to provide them the list of policies and procedues it followed.

This is a legal ruse to get information to help him in his criminal case. Discovery is much broader in civil suits than in criminal suits. He is hoping he can get stuff in a civil suit he couldn’t get in the criminal investigation.

I wonder if the DOJ will deliberately throw the case? That would be in keeping with their virtual rebellion against President Trump.
The first OIG report already recommended charges against McCabe. This Thursday We get a big report although it is rumored to be heavily redacted and cut. Yet I can’t help but think there is going to be some more recommendations of charges against McCabe in that along with some of the other deep staters. Hopefully Hillary too.
In any case assuming the DOJ Does not put McCabe above the law then he is going to be charged with crimes in the very near future. At that point McCabe will get his discovery. For all the good it will do him.
