I’ve heard her described as one of the strongest originalists we have, comparable to Scalia.

With all the rest, she would be a very good choice. And the left would be somewhat more restrained in attacking a woman nominee.

Why are so many FReepers so ill-informed about Roe v. Wade? People, you have to know what you’re talking about before you have any chance of convincing others...

Roe v Wade is largely a states rights issue, reversal would return the power of decision making over abortion to the states as it was prior to 1973. How many states would continue to offer abortions? Look at the Hillary map and you’d pretty much have the answer, but the others would once again be allowed to pass legislation governing abortion in their states, as it should be.

Abortion will be legal but some states will limit it...and the court will go along..

They may even limit it because of medical advancement

That should have been the decision in Roe v. Wade instead of the SCOTUS imposing legal abortion on the entire country.

Same applies to gay marriage.

How about, after a court decision, each Justice be required to write a brief report, stating the part of the Constitution they used to form their opinion, and cast their vote?
This would require them to at least think about their guiding principles, rather than their emotional “wisdom”.
Some accountability, as this, would put an end to much of the activism.

I truly don’t know, but taking the entirety of his rulings on other matters in context, just as a speculation, I’d guess it to be in line with upholding the laws of the land as written and as based on the Constitution (that a nation has the sovereign right and duty to protect its borders. So I suppose I should have said “illegal immigration”).

In general, you are right about women and their vulnerability to emotional arguments and evolving, but, there are some great ones who are exceptcions. Maggie Thatcher, Jean Kirkpatrick, Ayn Rand, Phyllis Schafley. If we find one of those, don’t discriminate because she’s a women. Too many men have evolved in the DC pressure cooker, too.

That stance is indeed emotionalism. They would never make the argument that slavery is OK, or a private “choice” or even should be left to the states. I don’t know why they’d see abortion (murder of infant humans) as any different. Unless they’d go as far as making the disingenuous argument that it’s not murder, that humans in the womb aren’t fully human.

I’d agree with at least kicking it back to the states, as an incremental tactic.

I didn’t think that Notre Dame university was especially conservative in recent times anyway, unless the Law College is a different matter.

His past support has been in that direction and his Goldman Sachs executive wife signed on to a Globalist plan for the U. S. without contradition or comment against by Ted AFAIK.

I knew all the details better after research in 16 that pushed me to be an early Trump supporter.
