Sorry, but you don't know what you're talking about.

There was an assault because for the split second before the drink was thrown on him he knew it was coming. There does not need to be a verbal threat in order for there to be assault. Assault is a reasonable fear of an imminent battery.

There was a battery also because there was an unwanted touching in the form of the soda being thrown at him. Yes, there was technically a robbery also because the hat was stolen from him through force, but a robbery does not negate a battery that preceded it.

So he could legitimately be charged with assault, battery and robbery.

What you described are the same exact series of events that lead to any random robbery that occur daily around the country: imminent fear, physical contact & theft (of person).

You must be awfully bored to spend time deconstructing an obvious point. By describing A&B in that context, you act to misserve justice by relegating felonious robbery.

When the perp pleas out for 5, it will be because of robbery of person - with enhancements - not A&B.
