I believe in stand your ground, but the video looks a lot more like murder or at best manslaughter.
The guy is assaulted and pushed to the ground. The assailant backs away. At that point in time the victim pulls his weapon and fires. All he needed to do at that point was wait for the cops. I saw no reason to fire. The video looks more like vengeance.
I cannot know the whole story, but this does not look justified.
You are going to get flamed for your post. But not by me. You make several excellent points.
I agree with you.
I posted the law in #12.
Just that push to the ground could have killed him.
If you want to stay alive, it wise not to assault people.
Why should anyone have to “wait for the cops”?
What if they don’t come before you die?
It is... yes the guy was shoved, but the man who shoved him clearly was no longer attacking or engaging him in an intimidating manner once he was on the ground.
But dont waste your breath on the argument here, too many will defend any gun use no matter how outrageous.
I am fully for self defense, but if this guy feels in fear for his life from a man who was backing away from him even before he was off the ground.. hes a coward not a cause.
I can see your point. At least by current namby-pamby laws.
In the old more sane days, this would still be acceptable, though.
Vengeance is a little strong. Anger, sure, after all he was just pushed down onto pavement. And he waited there. Did not just run to hide.
But I have to ask everyone: WHAT HANDICAPS DID ANY OF THESE PEOPLE HAVE?
Why exactly were they fighting? Was white guy simply do-gooder incensed that black girl took a space wrongly? Or was he handicapped and privileged for that space? Absolutely no word on this.
I disagree.
After being attacked how does the victum know the intent of the perp?
The perp didn't flee, he could have been drawing his own weapon.
Unless the perp had his hands clearly in the air, the victim had no way of knowing the attack was over.
I say it was legitimate self defense.
I saw the same video, but the victim is assaulted with no warning and violently pushed to the ground. The assailant stands looking at him with a threatening demeanor. The victim feels he will be further assaulted if he tries to get up and is in the disadvantageous position of being on the ground. There is no indication that cops or any other help is forthcoming in a timely manner.
Feeling under threat from his assailant, the victim takes out his firearm. The assailant clearly sees the firearm and makes no attempt to disengage.
Being under threat from a person of superior strength and tactical position, and fearing further physical harm, the victim defensively shoots his assailant.
I won’t make a legal call from behind my keyboard but it appears he made a couple of bad decisions.
What I was taught in a CCW course, that means no immediate lethal threat and no justification to shoot. The guy on the ground just sat up, aimed, and fired. Plain killing, fortunately caught on video so the State's Attorney will have a chance to reconsider. Should she have parked there? Of course not. Is that worth killing somebody? Not in my opinion.
“...this does not look justified.”
I’m not from Florida, but it doesn’t matter what it looks like to us.
It’s “THE LAW” in Florida. Don’t like it? Don’t live in Florida.
That great big brute won’t be shoving any more little old men to the pavement again.
He brought his brute strength to a gunfight.
You cant be putting your hands on someone because you dont like his words
“the guy is assaulted and pushed to the ground”
Yeh then he defended himself against a larger foe.
I don’t know the age of the guy who got knocked down, but I would have shot the attacker too.
>>The guy is assaulted and pushed to the ground. The assailant backs away.<<
Anyone who physically assaults another person except in self-defense fully deserves whatever the victim’s immediate response is at that moment.
I concur, not a good shoot. Man was out of line shoving shooter to the ground, shooter was no longer in danger when he killed the idiot who shoved him.
Unless something has changed, Stand your ground doesnt itself let you shoot. It lets you not have to flee.
When I carry, which is always except when going someplace I can't take my weapon, I choose to be a lot "meeker" and would not have even argued with the guy wanting the parking space I had chosen - I will defend me and mine with extreme prejudice but refuse to add any combustibles to something that doesn't need to escalate into a potentially dangerous/deadly encounter....I refuse to become a "hunter".
I assume you mean you believe in self-defense. But it looks like you're right otherwise. The guy was turned away and moving away. It looks like he chose to end the fight when he saw the gun, and then the other guy shot him anyway.
I agree. From our point of view.
