I think it would be covered by ‘Gulf of Tonkin’, right? 40 days [or so?] for President to address threats from outside the border if I’m not mistaken.

And, why’ll they’re at it, get some solid opinions on the limits of power of lower court judges to interfere with the President or to re-write laws.

The posse Comitatus Act expressly prohibits the use of the US Army on US Soil. The Department of the Navy instituted regulations to enforce the Act on the Navy and Marine Corps. The CiC can suspend those regulations and send the Marines to the Border. No violation of the law.
