A Pennsylvania caregiver who left a 4-year-old child to die in a hot car two years ago was fined just $25.

After deliberating for three hours last Friday, jurors acquitted Brittany Borgess, 30, of Williamsport, of the most serious charges against her, the AP reported.

Lycoming County Senior Judge Dudley Anderson found Borgess guilty of the summary charge of leaving a child unattended in a car. She fined her $25.

Holy Crap. She’s lucky it was only a child and not a dog, maybe.

She could have been fined $1,000 or more if she had killed a dog that way.

Or her cell phone.

Every time I turn off the key in my Volkswagen a message appears on the display.

“Don’t forget your cellphone”.

I’ve looked in the Owners Manual on how to change that display to...

“Don’t forget your BABY”.

But for some reason, THAT is not an option. I guess VW is more concerned about cellphones being left in cars than babies.

There was no justice in this case.

Her judgement should have centered on her having to sit in a hot car for enough hours to do the trick.

Horrible.

She should have been convicted of manslaughter.

With all the news and info about the danger of leaving children or pets in hot cars, she most certainly should not have left the kid in a hot car.

Horrible, as this is, I don’t believe in vigilante justice.

The judge who gave her this “sentence” needs to be recalled from his position and not hired anywhere else.

The Judge decided the fine of $25, even though the jury acquitted. $25 was a slap in the face to the family.

When the word ‘justice’ becomes totally risible as part of ‘criminal justice’ then a free people should assert their inalienable rights to justice in a more direct way. Tar and feather for the judge and something much more unpleasant for the perp.

Since the jury found the woman not guilty, I'm not what the judge could have done. However, IMO, the $25 fine is worse than fining her nothing.

In 1990, there were 4 hot car deaths. In 2010, there were 49.

Too bad it wasn't an older car with roll-down windows.

Borgess, who prosecutors said left family friend Samaria Motyka in an SUV with the windows closed for over six hours in July 2016, was acquitted of involuntary manslaughter, child endangerment and reckless endangerment.

It does not say.

She faced a jury of her peers, they acquitted her of the serious charges. The judge can do nothing once the jury speaks.

The jury heard testimony and evidence and the 12 of them agreed the facts and evidence did not meet the conditions the law for the crime charged. either the evidence/facts did not add up or the PA/DA did not make the case. Maybe both.

Agreed, something smells in PA; either the law is too vague or the process failed.
