Federal judge rules against Trump administration on border wall national emergency

A federal judge in El Paso, Texas, rules against the Trump administration on border wall funding, saying the national emergency declaration by Pres. Trump was unlawful.

I can see the headline already: "Trump gasses civilians! Staff left speechless! Bipartisan Condemnation from the Senate!"

My “memory” is that the SC lifted the stay on construction but did not make a ruling - I believe this has yet to come before the SC.

I can see this judge citing contempt of court but I can also see a Justice of the Supreme Court notifying this judge of a review for pf lower court contempt.

It’s a cat fight.

It’s not a ruling on a law, it’s a ruling on an executive action supported by the Constitution. That an El Paso judge doesn’t like the ruling is irrelevant.

So once again, the question is how you come up with ‘impeachable’?

The judiciary has no authority in this matter.

Judge should be impeached, convicted, and removed from the bench forfeiting all benefits. Only when this begins to happen will the rogue judiciary be brought under control.

Judge David Briones

The Honorable David Briones is a Senior U.S. District Judge for the Western District of Texas, El Paso Division. Appointed by President Bill Clinton in 1994, Judge Briones was the first Hispanic and the first native El Pasoan to serve the El Paso community on the federal bench. From 2003 to 2010, Judge Briones supported the administration of the judiciary by serving on the Judicial Conference Committee on the Administration of the Magistrate Judges System. He also oversaw the construction of the Albert Armendariz, Sr. U.S. Courthouse, a matter of substantial local importance.

Judge Briones began his legal career in private practice in El Paso, where he handled civil and criminal matters for twenty years and was a partner at the law firm of Moreno & Briones. From 1991 until his appointment to the federal bench three years later, Judge Briones served as a state judge for El Paso County Court at Law No. 1.

Judge Briones received his B.A. from the University of Texas at El Paso and his J.D. from The University of Texas School of Law.

On July 26, 2019, the Supreme Court stayed that lower court ruling that had sought to block the use of funds to construct the border wall, effectively ending debate over constitutionality of the President's emergency declaration.

I do not believe even this by Congress is sufficient, let alone this ruling by a lower court over the Supreme Court ruling on the issue

This might help you out.

The previous ruling in the President’s favor had to do with using finds marked for military construction in the construction of the Wall. The President won but he could not initially ignore the challenge because the appropriation was rooted with authority of Congress which is integral to making law. In other words, the previous case was rooted in law. So the Executive Branch was required to meet the challenge in court.

In this case, the judge’s challenge is to the President’s authority to declare a national emergency and to respond to that emergency by building a Wall. The judge cannot rule a law has been violated, he is ruling that the President’s declaration is unlawful and must show which laws were violated by the President’s actions. Now the judge might have a list of laws violated but they fall into the category of infractions which are handled by the Federal Court of Claims. They are not impeachable offenses, they are possibly at most infractions which can be used to recover damages in claims court.

If the Judge thinks he can override a Presidential Declaration, then that is overreaching and the higher courts will discipline this judge

A Judge is not a end all be all god. They are subject to appeal. This merely moves the battle out of this jackasses court.
