But so far these attacks have remained at state level crimes and not terrorism. Trump has allowed the states to implode. So this, at this time, is still considered attempted first degree murder as it is aimed at a no particular group and a created killing device with no protection intended. But if the states do not wish to prosecute them, then it can reach the level of an attack on federal property and people and Trump no longer needs the okay of a governor to enter.
