Supreme Court's Texas Ruling is Nothing Short of Disgrace

Friday evening the United States Supreme Court decided to not take the Texas lawsuit against four states over their application of presidential election law. The Court only mustered two justices in favor of taking the case: Samuel Alito and Clarence Thomas. The argument against hearing the case was that Texas lacked standing to sue Michigan, Georgia, Wisconsin, and Pennsylvania. Wow!

In a podcast titled “Is Secession Upon Us?” Ben Shapiro argued against the Supreme Court taking the Texas lawsuit. He reasoned that under principles of federalism it would threaten our union if the sovereign states could dictate the laws of other states without resulting direct damages. This goes to one of the three principles of legal standing. His concern considers that in the future, the Court under a left-leaning majority would use this concept to attack more conservative states and their laws. His thinking is reasonable and likely figured into a rejection of the case by the seven other justices. Yet, I doubt that this was the essential point in this case.

If we examine Marbury v. Madison (1803), Chief Justice John Marshall set the principle of judicial review of congressional laws. He determined that Section 13 of the Judiciary Act of 1789 violated Article III of the Constitution by illegally enlarging the role of the Supreme Court from an appellate jurisdiction to one of original jurisdiction. His reasoning was excellent. But one must also consider the political implications. President Thomas Jefferson, an ardent opponent of last-minute appointments made by the John Adams administration, would likely refuse to obey a writ of mandamus to sit Marbury as a judge, rendering the Court impotent.

IMO no matter the argument the Supreme Court was never going to take the case they wanted no part of that controversy

Doesn't Occam's Razor dictate a far simpler explanation, that the "Red Mirage" and subsequent "Blue Wave" did indeed materialize?

I have considered that theory carefully, but it does not explain the +15 GOP seats in the House, with no effort whatsoever by the Democrats to effectively cheat their way to a win in EVEN ONE close, contested House race.

There was a deal.

No doubt that factored into their decision......but ponder this:

How many of those litigant states used the rigged Dominion voting machines?

The answer to that demonstrates that the USSC aided and abetted state officials’ election tampering equipment/software of Dominion Voting Systems.

By rejecting the Texas lawsuit, the USSC effectively said, “we the Supreme Court permit you to manipulate and disenfranchise America voters outside the jurisdictional of your own state legislatures b/c numerous details in the Texas lawsuit exposed the tax-paid public servants as derelict......possibly criminal......in carrying out their duties.

Alarmingly, the USSC protected the tax-financed administrative state-——particularly those election officials who were beneficiaries of Zuckerbrg’s $400 million outlay.

AG’s in states who were party to Texas’ lawsuit, might now start investigating Dominion Voting Systems for their crimes, utilizing their own tax-financed L/E capabilities.

Where in the Constitution do individual State Legislatures have the power to pollute the air of neighboring states?

They DO have the power to appoint Electors, however.


Where in these four States did the State Legislatures allow for how their elections were run? Non-Legislative people made changes, against the laws, that resulted in a different outcome.

The ONLY authority to appoint those Electors rests with those four Legislatures. And they have elected Biden and Harris.

General strike. Refuse to work. If it came from Trump it most definitely will be noticed and make a very big impact. It’s not his style but we need to do something differently. Also, moratorium on collecting and prosecuting federal taxes and evasion of taxes. I’ve heard people discussing martial law etc. To me, these steps are much more effective and realistic. I think just voting for Senators isn’t going to fix this crap.

If one wants to posit that one is bound by the State one lives in when some cases involve US citizens and some cases affect ALL citizens, then the 11th would be right - if citizens have no standing when a few States disenfranchise the whole Nation, then we are not a nation but a bunch of tribes.

Absolutely right. SCOTUS has basically said that we're not the United States of America anymore. We are 50 disconnected states where in a national election for president of the entire country, some of the states can commit all sorts of mischief and steal it without any consequence or harm to the people of the other states who played by the rules. Votes are counted, then votes are manufactured after hours and nobody can do anything about it. Banana republic. The Various States and Factions of America. That's our name from now on.

Agreed, it was cowardly.

That was my take. I also wondered if they thought by not taking it, the "messiness" would go away. Boy, are they wrong.

I feel that, by not even giving the AG's a chance to present their case, they have basically said to millions of Americans, your voice will not be heard. We are not interested in hearing from you, shut up.

We now have NO representation. Shame on them, all of them, with the exception of Alito and Thomas.

And Amy Coney Barret -- we fought for you, hard. Now, you won't even let our representatives present their case? What's up with that?

one state having the legal standing to challenge election procedures in another state.

The challenge was not about the "procedures", the challenge was that the AG DID NOT follow their own procedures. It isn't Texas that wants to change their procedures; but, PA for not following their own procedures.

Maybe next time DON'T blindly accept ANY judge is "originalist" just because the White House SAYS they are? Maybe they're NOT awesome just because the federalist society put them on some "list"? Just a suggsetion.

What if Trump was indeed much more unpopular than the standard R candidate? What if Biden actually did win the late counted mail-in votes by large margins without fraud? Is that possible?

Yes it is.

In my small, 99.8% white town, Trump won by 370 votes in 2016 and by 15 votes in 2020. Total votes increased from 1700 to 2200 (approximately). Biden won 72% of the "new" votes.

The two minutes hate campaign was very effective.
