What the Supreme Court Should Say About the 2020 Election
American Thinker.com ^ | December 13, 2020 | Jerome Michaels

Americans who dabble outside the mainstream media are horrified by shocking claims of election fraud in 2020. Even more horrifying are courts that refuse to address the merits of these claims -- hiding behind baffling legal terms like laches, mootness, and standing. Here is a suggested Supreme Court opinion that would end the horror and preserve our constitutional Republic.

OPINION

Per Curiam We address several consolidated cases against various states and their officials (“Defendant States”) regarding the 2020 election. The cases make one basic claim -- the 2020 election in the Defendant States was rife with voting and tabulating irregularities, illegalities, and outright fraud (“election wrongdoing”) that uniformly favored one Presidential candidate. Plaintiffs claim this violated their constitutional right to a free and fair election.

Basic Principle: Free and Fair Elections

Our constitutional Republic is founded on the Declaration of Independence which states:

[A]ll men . . . are endowed by their creator with certain inalienable Rights…. [T]o secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed. . . .” (Emphasis added.)

[A]ll men . . . are endowed by their creator with certain inalienable Rights…. [T]o secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed. . . .” (Emphasis added.)

Government: Who Does What

The American people have seen an avalanche of punditry telling them how our government works. Many believe the news media “calls” the Presidential election. Others think this Court is a mystical, all-powerful institution that can wave its judicial wand and make everything right. Neither is true.

The United States Constitution gives the state legislatures the power to determine their election laws. Of course, they may not violate other constitutional principles in enacting and implementing those laws.

No. They betrayed their oath. The constitution places requirements on how states choose electors. At least two states clearly violated that part of the Const. SCOTUS had a responsibility to step in and at least hear the complaint. Instead, they took the swamp path.

Seven of the Supreme Court justices lack the intelligence and wisdom to comprehend what's going on in America and the courage to save the Republic.

Would that they had the intelligence, wisdom, and courage of the American boys who walked directly into Nazi machine gun fire on the beaches of Normandy in 1944 to save the United States and the world. In fact, far less courage would be required.

“If these states fail to legislate justly, then what?”
——————
That’s fairly obvious: either President Trump invokes the Insurrection Act (which isn’t called that anymore, but that’s just a name) and uses his powers under various EOs and laws enacted over the years to stop and reverse the coup against our Constitution or, alternatively, we let the power-hungry bastards get away with their naked power-grab, and hope that they are merciful. Logically, there is no other choice - and it is a choice that THEY forced upon the rest of the country by stealing a Presidential election. THEY crossed the Rubicon, THEY cast the die.

Either way, nothing can or will ever be the same - again, because the DEMOCRATS, in their uncontrolled lust for unlimited power, couldn’t abide by a deal that has worked for nearly 250 years: no party gets all of the power, EVER - but each party gets some always and leadership for a few years at a time. THEY ruined it, THEY broke the deal, THEY betrayed us, and every generation before and after us. Face facts, the American Republic is now as dead as the Roman Republic.

Our only choice now (and it is really President Trump’s choice) is whether we try to restore some semblance of what the Founders bequeathed to us and a dozen generations since have fought and bled to preserve, or we knuckle under to an illegal and naked grab for totalitarian power.

To believe otherwise is naive, it is to succumb to Normalcy Bias when normal is long dead and buried.

“The United States Constitution gives the state legislatures the power to determine their election laws.”

When the legislatures refuse, or ignore their job to address the election farce in their own state then who is left to correct the problem? Who has standing?

I always thought that SCOTUS was the defender of our Constitution, therefore when they fail to do their job the only thing left to defend our Constitution is martial law.

“ It’s over. The cheating left pulled out all stops and managed to succeed. All we can do now is survive what’s to come in the following years, and put our trust in God to protect us/provide for us.”
——————
I am quite happy that the Founding Generation believed that God helps those who help themselves, and not as you apparently do

No one likes the choice that we face - a war to stop those who have an uncontrollable lust for total power vs. effective slavery - but that choice has been thrust upon us by the Dems and their foreign backers/masters. **THEY** crossed the Rubicon, not us! Now is the time to choose - and as was the case 244 years ago, the fate of our nation rests in the hands of one man.

Agree!
They left us no choice but to
invoke the insurrection act
deploy military/defense
initiate mass arrests....

Everybody please contact Pres Trump to urge him to do this. Now is the time!

Technically they are still black robes. They’ve merely added a very wide yellow streak to the back.

Since it’s on the back, you won’t see it in any of the official photos...

‘I am quite happy that the Founding Generation believed that God helps those who help themselves, and not as you apparently do’

You know nothing about me whatsoever. I’m a member of DAR so I have a little knowledge about the founding fathers and their beliefs. I do believe God helps those who help themselves, but he also helps those who cannot. He also allows rain to fall on the good and the evil....so it may “rain” on the good in America to forward God’s plan whatever that may be. One thing I DO know is I’m not chasing for gold at the end of rainbows. If God chooses to allow Trump to somehow prevail, praise be to Him. If not? I do believe God will provide for me. If it’s His will I struggle, so be it as well, but do not assume. It’s usually wrong, and in your case it is.

By deferring that is, in essence, what they did: Uphold the Constitution.

The Executive Branch and the military have not been following Trump's orders for the past four years.

Why would they start now?

Copy liberals’ Sanctuaries model. Second Amendment Sanctuaries (already exist), pro-life Sanctuaries (a few exist). Have Sanctuaries for the First Amendment. Decide as a city, county or state to reject immoral federal regulations on a given topic, and like Sanctuary cities and states for illegals, make it A CRIME to assist fascists in power enforcing those oppressive rules.

Trump has installed patriots in the DOD, special operation agents to report directly to DOD, weakened CIA (CIA counterterrorism unit (i.e. assasinatio squad) will have power/funding striped effective 1/5/21) and raided election server run by CIA in Gemany....), space force added to cyber warfare unit....etc.

He has his military guys ready to work for him.......

And Biden (meaning Obama) has HIS military guys ready to work for HIM.

Do you REALLY want American soldiers and marines killing each other over this?

And after the killing is done, will what's left be worth having?
