Rep. Nadler Calls for Federal DOJ To Consider Charges Against Kyle Rittenhouse
Legal Insurrection ^ | Friday, November 19, 2021 | Teri Christoph

“This heartbreaking verdict is a miscarriage of justice and sets a dangerous precedent which justifies federal review by DOJ.”

The left’s reaction to Kyle Rittenhouse being acquitted of all charges was predictable and not particularly creative. According to them, he deserves to die, rot in hell, yadda, yadda, yadda.

But one Democrat is taking things further by calling on the Biden DOJ to consider federal charges against Rittenhouse. Rep. Jerry Nadler, who is chairman of the House Judiciary Committee, tweeted his call for a federal review just hours after the jury’s verdict was announced.

Many on the left, who so nonchalantly and callously dismiss the damage done to people and property by BLM and Antifa, support Nadler’s call for a federal investigation. It could be argued that Democrats are so accustomed to things going their way that they can’t handle it when they lose.

Nadler would be wise to step away from his emotions over the verdict and think about the repercussions of pushing the narrative that Kyle Rittenhouse was a white supremacist who violated the civil rights of his attackers. The government failed — spectacularly! — in making that case and the Kenosha jury decided what most knew all along: it was simply a case of self-defense.

That is how the Feds convicted the two Los Angeles policemen who were acquitted of state charges in connection with Rodney King 30 years ago. If the DOJ decides to go after Rittenhouse, he would probably be tried in Milwaukee, where a more biased jury can be drummed up by Merrick Garland's prosecutors.

There are no federal laws which address this. It is purely a state issue.

Not that that has stopped the leftist DOJ from unconstitutionally inserting itself where it doesn’t belong.

I am not a lawyer, but would that not constitute “double jeopardy”? (The Double Jeopardy Clause in the Fifth Amendment to the US Constitution prohibits anyone from being prosecuted twice for substantially the same crime.) Can a Freeper more knowledgeable than I on these matters weigh in?

This never stops the feds when they want to assuage the screaming crowd. The Semi Valley police officers who allegedly "beat" Rodney King were acquitted by a Jury all to be brought up on phony baloney Federal "civil rights" charges because the Feds didn't like the verdict.

They claim that being tried in a Federal Jurisdiction is not "double jeopardy because the original trial was in State jurisdiction and the charges are different.

"Civil Rights" violation is a catchall that means any d@mn thing the Feds want it to mean.

They claim it is a different charge in a different jurisdiction, and therefore "double jeopardy" doesn't apply.

It's bullsh*t, but they get away with it every time they do it.

A federal criminal charge would not constitute double jeopardy because the federal government is a separate sovereign from the state.

But it is more difficult to charge a civilian with a civil rights violation then, for example, a member of law enforcement. I would be surprised if federal charges are filed regarding the shootings.

Add to this, the scumbags at MSNBC:

“Civil rights lawyer David Henderson discusses if the families of Anthony Huber and Joseph Rosenbaum go to a civil suit after Kyle Rittenhouse is found not guilty on all charges.”

If you are a leftist you just make up s&^%.

If the law helps your case you use the law.

If the facts help your case you use the facts.

If you have neither the law nor the facts, you pound the table!

There is a big difference legally between charging a civilian, and charging police officers who are acting under color of state law.

In America 2.0 “right wing” suspects are guilty even after being proven innocent in a court of law.

In America 2.0 “right wing” suspects get “double jeopardy” while left wing suspects get zero jeopardy and are released.

Countersuit, plus legal expenses, will nip that in the bud.
