I hope he has a copy overseas in custody of someone else with instructions to release it. If the Trump family receives a court order to not release the tapes, but there is a copy "out of their control" that just happens to be released they might be able to avoid even more legal problems.

There are many reasons for not releasing them now.
Probably because Trump wants to release it within 3 months of HIS election, not within 3 months of the midterms.
