Standard for these motions: There is No genuine issue of material fact and the moving party is entitled to judgment as a matter of law. Very Common in civil litigation, and it is not an unconstitutional deprivation of the right to a jury trial.
The ‘value’ of a thing, in reality, is exactly what someone is willing to give you for that thing AND what you are willing to accept for that thing.

Since ALL Real Estate Appraisals are subjective and values can change at any given moment, how does one demonstrate they are false??
I don’t know how it works in NY, but wouldn’t you pay property tax on the property’s assessed value? So not only are there no victims, but the state gained tax revenue it was not entitled to take, according to the state’s persecution?
And even if Trump did everything the prosecutor says he did, this would be a civil matter between the lenders and Trump.
None of the lenders have filed suit against Trump in this matter — for two reasons:
1. The loans aren’t in default, which means the lenders have no standing to sue because they can’t demonstrate that they’ve been harmed (which also means there’s no basis for a criminal case).
2. Any bank that sued Trump over this would get laughed out of court for failing to do its own due diligence (through third-party appraisals, for example) before lending money. Imagine being the CEO of a bank testifying in court that you lent money to a customer based on the customer’s own representations about the value of his properties. “My $250,000 home is worth $2 million, Mr. Mortgage Officer. I swear!”
Without a trial, gee what is the prick afraid of, that even with 12 Trump hating buffoons they might still acquit him
