Texas Stripped of Powers in Border Security Bill
Newsweek ^ | Feb 06, 2024 at 9:32 AM EST | By Sean O'Driscoll Senior Crime and Courts Reporter

Conservatives have attacked a provision of the new border security bill that would only allow legal challenges to be made in Washington D.C.

The bill would strip the power of Texas and other states to challenge some of the its provisions in their local federal court.

Conservative commentators were quick to denounce the provision, contained on page 221 of the bill. Bill Shipley, who was a federal prosecutor for over 20 years, decried the its court provisions on X, formerly Twitter, on Sunday.

"This would prevent plaintiffs - like the State of Texas - from filing suit in Texas federal courts. This is corrupt," he wrote.

After outlining the provisions under which immigrants can seek judicial review of a deportation order, the bill states:

"The United States District Court for the District of Columbia shall have sole and original jurisdiction to hear challenges, whether constitutional or otherwise, to the validity of this section or any written policy directive, written policy guideline, written procedure, or the implementation thereof."

The right of judicial review for illegal immigrants about to be deported has proved controversial.

In 2022, a Louisiana federal judge blocked the Biden administration from ending Title 42, a pandemic-related border restriction that allows for the immediate expulsion of asylum-seekers and other migrants.

Reacting to the latest provisions in the border security bill, conservative writer and self-style "deportation scientist" Mike Howell wrote on X that the bill "puts far left DC district court in charge."

I heard Dan Bongino say that yesterday, and almost drove off the road.

“We are not electing our bestest and brightest............”

Democrat lawyers are the ones writing these bills and Repulicans are too elated thinking about their new Swiss bank accounts to bother reading them.

That’s what I believe to be a violation of a state’s rights, as spelled out in the Constitution.

They really want a civil war.

You really have to wonder whether it’s deliberate

Oh I'm sure it's deliberate. The federal govn won't work on behalf of the people if it can get away with it. That's why Washington DC needs an enema.

The Swamp just revealed that the United States District Court for the District of Columbia and the United States Court of Appeals for the District of Columbia Circuit are kangaroo courts with pre-determined "outcomes".

These two federal courts are no different than The People's Court of Nazi Germany (German: Der Volksgerichtshof), which was a Sondergericht ("special court") of the Nazis. The verdicts of this "court" ALWAYS went the "correct" way for the regime.

This is why our ruling junta [The Tater regime] loves the DC federal courts.

The ugly face of tyranny...burn the bill up...arrest those pushing it and exile them permanently.

It’s time for the Republic of Texas to remove its star from the third world United States flag. This country isn’t America anymore. Let the foreign buzzards pick the former U.S. carcass clean.

The only hope for the country right now, I think, is for several states to table legislation that puts secession to the vote. Without that, the federal government is going to remove a state’s rights.

It makes Texas a vassal state of the African nation of Washington D.C.

This bill is the GOPe’s latest attempt to proactively surrender in spite of having all of the political wind at their back on illegal immigration. We must purge the GOP of RINOs, leftists and crooks.

I would say this is unconstitutional, but the Hussein/Biden Regime, and most democRATS, have never cared about such things. They openly declare their admiration for the Marxist Chicoms, and the Chicoms’ ability to get things done.

Is there anyone left who thinks that the GOPe is on our side? They are Leftist Democrats. Every last one of them needs to be voted out.

“...they don’t even pay attention to it.”

This is the problem with 500+ page bills. No Senator is going to take the time to read it and find out what little gems like this are tucked away in it before the vote is called.

A long time ago, I took a speed-reading course. It was a bit of a fad in the 60s. It does work and it is a useful skill. Senators need people with this skill to keep crap like this becoming law.

Happily it appears that there are some who have read the text of the bill and letting us know what is in it.

“The bill is unconstitutional on its face.“

Good luck getting Roberts and the girls smack it down.

They arrested the NYC cop beaters in Phoenix last night. Just shows how easy it is if the federal government has a will to enforce the law.

If members of Congress wanted to know what is in a bill before they vote on it, they could accomplish this by dividing up the pages in the bill, having 2 or 3 different Senators (or smart members of their staff) read their alloted part. Then they could share their findings, especially the hidden worst parts. ... all before the vote.

Unfortunately, having plausible deniability is more important to them. Same for representatives in the House.
