Swerving...I’ll bet it’s on dashcam video...ought to be reason enough for a field sobriety test.

They cops where I live don't even show up unless you report a shooting.

I don't rely on the police, and my past experience via friends and family is that some are good but many are thugs.

He’s a patrolman in a rural town. But he patrols alone. He gets backup from other officers on duty or nearby towns, but he’s basically alone.

He says the most dangerous call is domestic disturbance. You never know what they have, and they’re usually too drunk to even know what they’re doing.

He usually parks a few houses down and slowly walks up the street to the house, listening to what’s going on before making his presence known, and that from behind cover.

Maybe. Or maybe the car just crossed the center line by a few feet. Or maybe the cops were lying.

If they were lying and there was no probable cause for the stop, the whole case may be thrown out.

There seems to be an inordinate faith in police claims in this thread.

Probable cause for a stop. What was the probable cause to ask him to exit the vehicle?
***************************
The PROBABLE CAUSE was the ERRATIC DRIVING. Enough to get him out of the car to perform sobriety tests.

There seems to be an inordinate hatred of police in you judging by the fact that all you have done this entire thread is excuse the individual who murdered one person and wounded another. Yes, those two cops were people and you have zero compassion for them. Your compassion is only for the perp who was able to grab and fire his weapon despite ignoring being tased multiple times. What that usually means is the individual is on something.

Oh, well, what the hell, nobody was coming the other way. I guess we can all weave down the roads.

If they were lying and there was no probable cause for the stop, the whole case may be thrown out.

You don’t think they’ll have evidence of the vehicle failing to maintain a lane of travel? Any citation may result in a court appearance. This isn’t their first traffic stop. If anything, she was remiss in not taking better control of the situation. Dude shouldn’t have been on the phone, talking to his Meemaw about being pulled over for driving while black.

There seems to be an inordinate faith in police claims in this thread.

As well as an inordinate questioning of the cops’ motives. This is why the cops take videos. They can be edited by the media, for brevity, or to obfuscate. In court, the whole thing will be shown.

I’ll be curious to see the story of the perp, when apprehended.

Depends on the state. It's also dubious on constitutional grounds.

Incorrect. I cited the USSC decision. It applies to all 50 states. You can characterize the USSC decision as "dubious on constitutional grounds" if you like but it will take the USSC to reverse it.

One legitimate reason is "officer safety." But with compliance before being asked to step out it's hard to say how "officer safety."

Police don't need to articulate a reason to get you out of your car. It's a lawful order regardless of your behavior. Obviously, they have to get the guy out of the car to search it after smelling weed.

As far as his appearance, my barber has tats like that guy and is also huge. He also has a wife and two kids and wouldn't hurt a fly

I don't care about his tats. I think the fact that he is a felon who can't legally carry a gun is more relevant.

And was this even a criminal offense? In most places a traffic ticket a civil offense.

Once again, it matters not the type of offense. It was a legitimate traffic stop for failure to maintain a lane, compounded by the odor of weed. Put those together and the officer has a public safety obligation to investigate if he has weed in the car and if he is impaired. Both require him to exit the car

So one cop dead, another wounded, and guy with murder charges over a civil offense

I agree it is tragic that this dirtbag decided to shoot cops rather than get a couple of tickets. Although, he probably realized he would be going back to jail after they found the illegal weapon. So, in reality more than a "civil offense". Regardless, it is 100% the dirtbag's fault and it is absolutely disgusting that you would blame the officers. Sickening.

Now that's professional policing! /s

Yes, that's how professional policing is actually done. I guess in your world anyone could just refuse to comply and be on their way to kill an innocent family in a head-on collision.

You don’t know what you’re talking about. The whole video is available on the internet. He crossed the center line multiple times. That’s enough to tell him to get out of the vehicle for sobriety tests. The cops were not lying.
The case will not be thrown out. He is in jail now with two accomplices who helped him evade capture. He has a long rap sheet.

Surprise, surprise, surprise. Another dindunuffin kills a white man. Expect the black community to rally around him and defend his actions.

A police officer is supposed to investigate, not presume, which is what they did and you are doing.
*********************
And that’s what she was doing. Investigating. That’s why she told him to get out of the car. To investigate.

In Tennessee, reckless driving is a class B misdemeanor. So they already had probable cause to arrest him whether they found weed or not. I don’t like bad cops myself but I fail to see any inappropriate behavior here.

“When they immediately ask you step out of the vehicle that's good indicator they're fishing for a reason to arrest you.”

Reminds me of what some daddies always tell their children.

One, keep $55,000 cash in the house at all times.

Two, if a policeman asks you to step out of the car, kill him.

DeHart was arrested on Tuesday after a five-day manhunt and charged with first-degree murder, attempted first-degree murder and being a felon in possession of a weapon.

Scratching my head on why they didn't know that they were dealing with a felon (and no details in the article on that fact).

Horrible, avoidable tragedy.

How do you know they didn’t know he was a felon? Seems like it would have turned up in the ID check. She may have wanted him out of the vehicle to keep him away from concealed weapons.

Me either. Or were you saying I'm one of the thumb-sucking, ass-kissing Marx-following Democrat soy boys assuming the position for the Democrat Party? And artichokes among my favorite vegetables...

We're missing the beginning part. We don't know what constitutes a "swerve" or if the officer is just making it up. I don't see them ask for id, registration & insurance.

If, as I said, if the cop just walks up and demands you step out and says it's because they "smell weed," it's probably a bull--- stop. They've already made a determination of guilt and will try to get you to dance Swan Lake so they can say you failed a field sobriety check.

It will be interesting to find out if they have any dashcam video.
