HAMILTON - A Hamilton man found guilty by a French court of being a member of an Islamic terrorist group has been released on bail.

A judge ruled Friday that Abdellah Ouzghar is not a threat to the public, and will probably not flee because of strong ties to the community – including the fact that he is married to a Canadian citizen. Ontario Superior Court Justice Ian Nordheimer also questioned the strength of France's case against Ouzghar, who has been a Canadian resident since 1990. The judge freed him on $5,000 bail.

Ouzghar was arrested at his home in Hamilton on Oct. 12. The French government wants Ottawa to extradite him. He was one of two dozen men convicted in absentia by a Paris court earlier this year.

In April, a French judge imposed a five-year sentence after Ouzghar was convicted of being part of a Canadian cell of an Algerian Islamic terrorist group, and helping produce fake passports.

But on Friday, Justice Nordheimer said he had concerns about what happened in France because Ouzghar was found guilty without even knowning he was on trial.

Defence lawyer Rocco Galati accused the French government of railroading his client on "flimsy evidence," and questioned why his client was not even told about the prosecution until more than two months after he was convicted. Galati said RCMP officers have known for years where he was living in Hamilton.

Federal Justice Minister Anne McLellan has until Dec. 26 to decide whether to approve the extradition request.

at some point, even the utter blind, deaf dimwits who populate our state department are going to be forced to recognize that this is all of a piece: muslim fanatics -- and perhaps i repeat myself, but i hope not -- are active all over the place; when you hear a bomb go off among civilians, the changes are it's a diaperhead who did it. that is sad, and it's too bad for such decent mecca benders as exist, but in that they are not willing to police themselves, it will sooner or later become clear that someone else needs to do the policing for them. of course, they know who their bad guys are, while all we know is that the bad guys are among them. therefore, our action (and by "our" i include israel's) is certainly going to be less precise than theirs. but since the first of september, i have found less and less reason to react in horror at the notion of the extinction of islam.
