Good question. Maybe the same basis they had for outlawing pot and other drugs, i.e: NOTHING Constitutional. If you have to ask that question, you KNOW they are 1000% wrong but you don't seem to care much, do you?

Our Constitution doesn't require that laws be wise. Confusing policy questions with Constitutional questions is pretty common.
