This case is probably going to be presented to the Supreme Court regardless of the outcome in the Ninth Circuit. There is a chance that FR will prevail in the Ninth Circuit.

The first factor is the three-judge panel that is randomly selected to hear each appeal. But -- important but -- "liberal" and "conservative" lose a good bit of their meaning when applied to judges. For instance, on the Supreme Court it is the "liberals" who say that where the First Amendment says, "Congress shall make no law," it means Congress shall make no law. It is the "conservatives" who often take the opposite approach.

It is far, far better to win in the Ninth Circuit and have the L.A. Slimes and the Washington Pest take the case up, than to lose there and have to take it up ourselves. The reason is that the Supreme Court only takes 0.5% (a half a percent) of the cases offered to it for review. The usual fate of cases presented is to leave the lower court decision standing, without comment.

I will seek a way to file an amicus curia brief in the Supreme Court on behalf of FreeRepublic's position. There will be many interested parties who will support its viewpoint. (When that comes around, it will be either my 18th or 19th brief in that court. None have been more honorable than this one will be.)

Humm, we can go places with that label. Declare ourselves and endangered species, maybe. Or our own special minority, we might even ask for legislation banning hate crimes against us.

I think a label like this cries out for government funding of some kind. Or maybe our own State?

I don't agree with your contention that America is an oligarchy, in the sense that a small group of selfish people, have a corrupt control over the government. But I do agree with you, that America's government, is controlled by two powerful political parties, as in a duopoly.

However, if you look at the political history of America, you will see, we've always had two predominate political parties, at any one time. I kinda like it too. I'll take our system of government and politics over those that exist, in any other nation of the world. That includes France, Italy, Germany and Great Britain.

I also have to disagree with you, that the US Constitution has been hijacked. I'd say that's an unfair assessment and one that isn't held by a majority of American's. The Constitution has been under constant assault since the nations founding, but has continued to survive, throughout our entire history. OTOH, since the 1930`s and even more so, since the 1960`s, both major political parties have strayed from many of the basic intentions of the Constitution and are to blame for the excessive taxation, which has lead to the gross expansion of the federal government. Personally, I think Democrat's have been, by far, the worse offenders.

What we need is more conservatives elected to public office, if we're ever to turn back the tide of liberal-socialism. Right now, I don't know if there are enough real conservatives willing to run for political office and eventually make a difference. Remember, political change comes slow. For now, I'll take any incrementalism that conservatives and republicans can advance in the cause of freedom and liberty.

I think Jim Robinson and FR have unleashed an unstoppable conservative force. FR as we know it might cease to exist, but I think one day we'll read about Jim and this site in the history books.

Right On CD! FR is proof that you can't swindle an honest man. We don't ask for freebies-we work for a living and expect to be treated as thinking, rational beings. full stop.
