The families of 11 immigrants who died illegally crossing into Arizona from Mexico have filed a $41 million claim against two federal agencies, saying the government's refusal to put water out in the desert contributed to the migrants' deaths.
The action filed against the Department of Interior and the U.S. Fish and Wildlife Service asks for $3.75 million for each of the deceased, whose bodies were found last year in the Cabeza Prieta National Wildlife Refuge between Tucson and Yuma.

Well gee. They were in Mexico, they tried to get into the USA where they knew they shouldn't be, and they dry up and blow away trying. Maybe the families should be sued for encouraging the attempts (if that turns out to be the case).

In the good ol' days immigrants could find pride in the warfields, oceans, and other hardships they crossed to reach the promised land of America. Blacks had the struggle of capture and slave ships.
I guess the new paradigm will be sagas about crossing a Sonoran desert laced with refreshment stations proffering cold drinks and nourishing snacks.

Whatever happened to the legal premise that the law cannot permit one to gain directly or indirectly from an illegal act? Had the dead not broken the law, they would not be dead. Ergo, their estates cannot be permitted to sue.
Furthermore, isn't it also true, that in the commission of a crime, someone dies while committing the illegal action, any who participated in that crime, before or after the fact, may be tried for murder?

The local paper had a reply from the Yuma Border Patrol concerning this lawsuit. Basically it said...
1. The water stops requested wouldn't have helped those that died, as it wasn't anywhere near the area.
2. The U.S. already provides safe access into the U.S. via it's ports of entry.
So what more is needed?

Their lawyers need to be put in jail for 90 days without privledge (that's no mail, no phone calls and no visits) just for fileing these bogus suites and tying up our courts when we are so short-handed for judges.
