For example, even though it was known that AlQaida was going to highjack airliners, there was no alert to the airports to keep mid-Eastern types off of the airliners until they could be vetted, which would be the logical thing to do. Yes, but discrimination is still illegal, is it not? You can't just "keep mid-Eastern types" off airplanes. Substitute "black", "Christian", or "female" into that equation and see if it flies.
