These documents were designed to limit and eliminate the vicious Equity, Maritime or Admiralty Law which was what we revolted against as Our Revolution against the totalitarianism of England. Truly silly. England of 1775 as a totalitarian state! The English government was incredibly corrupt, but it was FAR too inefficient to be totalitarian.
I think the point of this article is that the entire US court system is operating outside Constitutional parameters.
