La. also has what is called "shoot the burglar" law..he shouldn't have been arrested and will not (probably) go to trial and if so will not be convicted....but then in New Orleans you are actually in another country....it isn't really part of the state of La....it is mainly located in the state of disarray and confusion.

Well, thank God for disarray and confusion, because New Orleans has some of the best food on the planet! My wife and I make an annual pilgrimage there. Les bons temps rouillier!

Well ,Texas is a whole nuther country and if Minor was to move to the west side of the sabine river, what he did would have been perfectly legal.Since I didn't read all the other responses,I am sure some other Texan brought that to the attention of this thread.

politically it is. Make no bones about it. If it wasn't for New Orleans, Louisiana would be solidly Republican with a few conservative Democrat exceptions.

Sean Minor, 29, was charged with manslaughter in the shooting, because officers say he wasn’t in danger at the time of the incident.

Didn't we just see an article within the last few days where a cop shot at some teenagers who were tp'ing his yard. No arrest.

Warning shots...HELL! The first warning shot should be to the center of mass followed by a shot to the head. Warning shots are dangerous.

Exactly! What if one of those warning shots had hit the car? He would have had to pay for a replacement windshield out of his own pocket, because the insurance company sure wouldn't pay for it. lol.

Standing off at a safe distance and shooting a thief who poses no immediate threat to your person or to anyone else is NOT justifiable homicide. I'm a gun owner and a great believer in self-defense, but this ain't it.

Maybe not under the letter of current law, but I can tell you that, as a juror, I would never convict

You're quite right. It's a matter of what value you place on a human life over property. I wonder if some these people would be saying the same thing if the dead kid were their own son?

Who knows what the future would have been. Perhaps the car theft was an isolated incident, and the perp would have gone on to become an honor student, get his medical degree, and discover a cure for cancer

More likely, the perp would have continued stealing stuff, graduated to armed robbery, and would have wound up raping and killing a few innocents before winding up in jail. In which case the shooter did the human race a favor

"When you steal a man's property, you steal a segment of his life. No man should have to submit to that. "

Unless of course 51% of the voters say it's ok, of course.

There's an old saying out West that says:
We don't hang people because they steal horses. We hang people so others won't.

"Well maybe he can argue that he was aiming for the leg. I would have done that, because I believe that someone trying to steal my property deserves pain before death."

I speak from personal experience, there's nothing like the sound of a shattering knee cap and the resulting scream to dear God.

"Two words: warning shot."

Dang straight. Shoot him and then yell, "Halt! Halt! Halt!"

"If you find a stranger in your daughter's room, standing over her bed, it is reasonable for you to shoot. If the bad guy is trying to escape out the window at the time, you're probably not ok. A fleeing perp is not a threat. If the perp is on the other side of the room from your duaghter and freezes, so that he isn't threatening you or her, you can't shoot. If you do, you'll have to explain why you thought he was a threat. Realistically, as long as you don't shoot the perp in the back, shooting a stranger who broke into your house will probably not lead to prosecution."

My daughter's well being is worth more than a rapists life. I wouldn't take the risk of letting him crawl out the window, agonizing over the thought (and her agonizing over the thought) that the beast might come back another night and finish with my daughter. If he was in her room, going in or out, he's dead!
