Reply SA farmer and two SA opposition parties want Mugabe arrested for crimes against humanity
Cape Town - Sept 4, 2002 -- Richard Barry, a Robertson farmer with property in Zimbabwe -- wants Zimbabwean president Robert Mugabe arrested and prosecuted in South Africa for crimes against humanity. LIST OF VICTIMS NAMES:Barry and Democratic Alliance justice portfolio spokesman Dr Tertius Delport invoked the Implementation of the Rome Statute of the International Criminal Court Act -- of which South Africa is a signatory-member and for which Zimbabwe signed up with a formal intent to join agreement -- came into operation on July 18. This Statute also was incorporated into South African law, giving local courts jurisdiction in cases of crimes against humanity, war crimes and genocide.A day earlier, in a protest march against the Mugabe regime by the Christian Democratic Party at the Earth Summit in Sandton, leader Rudi du Plooy rudi@cdp.org.za also handed a memorandum to representatives of Western countries and the Nigerian government-- calling on them to charge Zimbabwean dictator Robert Mugabe with crimes against humanity through the International Criminal Court."Immunity clause not valid for crimes against humanity:"
And Stellenbosch University lecturer in international criminal law, Gerhard Kemp, said the South African law expressly excluded using a defence of "immunity" for heads of state accused of crimes against humanity, war crimes and genocide.Kemp said South African courts would have jurisdiction even if the victims were not South Africans, as long as the alleged perpetrator was inside South Africa. Extradiction could also be requested by the SA government.DA justice spokesperson Dr Tertius Delport said Barry's affidavit has been faxed to national director of public prosecutions Bulelani Ngcuka.The original was lodged with the provincial directorate in Cape Town."The Act stipulates if any of those crimes are committed against any South African citizen anywhere in the world, that perpetrator is subject to the South African courts to be heard here and tried here in South Africa by our own courts," Delport said.
