I think the Dems are doing this one on the fly. No one thought the memo would be released before the election. Once that happened, this race started falling apart.
The Dems are fourth and long. This one is a Hail Mary from their own endzone.

New Jersey's newest state Supreme Court Justice, Barry T. Albin, was a contributor to Sen. Bob Torricelli's campaign and should recuse himself from a hearing tomorrow to consider whether Democrats can replace the Senator on the ballot, a GOP Assemblyman said today.
"A Judge should not participate in any decision in which his impartiality might reasonably be called into question," said Assemblyman Michael Patrick Carroll, a Morris County Republican. "If Justice Albin donated to the Torricelli campaign, participation in this case would inevitably entail the impression of impropriety."
"Especially in view of the fact that the statute herein involved does not authorize the relief sought, and the Court is being asked to craft a remedy with huge political consequences, the participation of a new Justice, with a history of recent contributions to one of the affected parties, inevitably creates the impression of partisanship. Justice Albin should not participate in rendering the decision."

I just don't understand the mentality of some on this board that moderates aren't real Republicans... I'm a moderate and I always vote straight Republican tickets... Why am I second class citizen in this party? Why should I bother to fight the cause for this party if all I'm ever going to get is dissed?

Although I don't believe it to be true, some folks here who say that most GOP candidates are RINO's, and thus should not be supported, and in fact deserve to lose because they are water carriers for the Socialist state, behave as if they were Dem operatives. I doubt that they are, they just advocate as if they were in a conservative forum. It is just an unfortunate coincidence.

Senate Majority Leader Tom Daschle, D-S.D., said that by objecting to Torricelli's request, Republicans were "denying the people of New Jersey a choice" in the election. Hmmmmmm. I'd have sworn the people of New Jersey had a choice when they RE-NOMINATED a SLEAZE-BALL SENATOR.

Makes my point, really. Claim to cite Miller and just make a decision out of whole cloth that has nothing to do with the cited case. And IMO the SCONJ doesn't even have the equivalent of Miller to cite here - they have one case where the guy died and the NJ courts allowed someone else on the ballot. Toricelli can still legally take the Senate seat if he were elected. We'll have to see what SCONJ values more - it's reputation or its political affiliation.
