Malvo is at LEAST an accessory to murder. It cannot be said that he was NOT the shooter in any of the murders, including the Alabama liquor store murder.

A composite sketch of Malvo was taken from a witness at the Alabama murder. It was very accurate. He close enough to the scene to be fingered. He wasn't hiding behind a bush or quivering on the floor of the car. He was right in on the action.
