I know you're being sarcastic; but if the Constitution does not apply, then neither does ANY law ever passed since the Constitution is the basis for all law in the US.

It might just be the Governments willingness to point a gun at the head of those who violate laws and force compliance that determines whether a law applies, not whether there is any Constitutional bases. The majority of today’s laws have no authority in any Constitutional power enumerated anywhere in the Constitution.
