For "personal use" amounts, fine. With an escallation in the fine for second and third offenses. Maybe mandatory drug counselling (not that it works, just to show the user that help is available when he is ready for it). Possible jail thereafter. I would just keep the same moderate fine at each offence. The purpose would be to stigmatise the use or possesion as illegal and force the offenders to stay "in the closet". I think that the legal pressure should be a notch higher to the one applied to parking car in the handicapped space or jaywalking. I think that this would calibrate the response to the OPTIMUM level.

I understand what you're saying. But if the fine were moderate and constant, the user would just consider it a cost of smoking. Many would gladly pay a moderate fine if and when they're caught, assuming there were no other consequences.
