Since Fox would have no interview without Bennett's participation, I fail to see why he doesn't have as much right to use the interview as Fox does. He's not using the entire show--just the portion that has his interview. Even if the court would disagree with that argument, I'd say Bennett is still protected under Fair Use.

I personally think Fox is making a big mistake by going ahead with this suit. A lot of us think O'Reilly made an ass of himself, and we are entitled to that opinion. I'd actually forgotten about this, but now I see that O'Reilly is just one ass amoung others at Fox.

I like Fox News and I generally watch a segment or two of O'Reilly.

The fact is, however, that unless Bennett signed some form before appearing on the show that says he has no right to comment or use the segment, that it is a part of his "life."

If it were an outsider using the O'Reilly segment, fine, maybe they shouldn't be able to use it without some restrictions. In this case, however, this is a "live" segment, not a movie or a production. Since the 2 people who appear "live" are O'Reilly and Bennett, either of them should have access to those moments of their own lives.

If I were Bennett I'd be afraid of a lawsuit. When libertarians see he's lumped Bill in with them there're gonna be mad as h3ll, and you can't blame them.

O'Reillys a gun grabber, nothing libertarian about him.

My stance is simple. We're all Americans here. Nobody should be discriminated against.

For like, their behavior? Hmmm. Don't think you can even begin to defend that position Bill.

To BO, the only GOOD Christian is a lukewarm Christian like himself. Wears his Christianity like and insurance policy. Believes the Bible is to be accepted and rejected like a smorgasboard. Homosexuality is a sin and Jesus really didn't mean that he was the ONLY way to heaven but one way. Apparently his priest told him that.

My guess is he has a homosexual priest. He basically calls any Christian who believes the entire word is a religious fanatic. He should stay away from theology because he is way off base and shows he's liberal on social issues.

I personally think Fox is making a big mistake by going ahead with this suit.

I think so too.

Remember when Howard Stern made those shocking comments about how the Columbine killers should have raped the school's better looking girls before killing them? When Donald Wildmon of the American Family Association condemned him for the remarks and some Stern-supporters agreed, Stern insisted that his words were taken out of context.

Wildmon struck back by posting on the AFA website an actual recording of Stern's comments, showing that he said that if he was going to kill the Columbine girls, "...I would take them out with some sex."

CBS sent Wildmon a letter threatening him and AFA with legal action, citing copyrights and what-all. Wildmon posted the letter on the site, and added an open letter to CBS in response: "So that there will be no misunderstanding, I will make my answer short. Sue."

CBS backed down.

More than anything, the Gay-stapo is afraid of the truth coming out about anything that hurts its agendas. They will do whatever it takes to stifle evidence of their true intents and motives. That's why most people who have heard of "Fistgate" have never heard the tape of it.
