Ken Starr Tips Us Off on Estrada

Democrats demand to see a memorandum Miguel Estrada wrote on various legal cases while he was an assistant solicitor general - a post he held under Bill Clinton. Remember: the solicitor general argues cases for the government before the Supreme Court. I interviewed Ken Starr for the Limbaugh Letter on Wednesday, and we talked at length about this. If you want to learn about how the Supreme Court works, I highly recommend Judge Starr's latest book: First Among Equals.

Democrats claim to want "full disclosure." (They held a hearing for Estrada when they controlled the Senate, so why didn't they ask their questions then?) Hey, we're all for full-disclosure, too! Ted Kennedy on Chappaquiddick; Hillary Clinton on Rose Law Firm's billing records; Bill Clinton on Juanita Broaddrick's rape charges - and how about full disclosure on how much Tom and Linda Daschle make off Mrs. Daschle's lobbying of the House? I'd pronounce all the legislation she lobbies for DOA until I got "full disclosure" on that.

We don't need judges or trials at all if all they're going to do is vote one way all the time. No previous person has been forced to release these kinds writings; it is a separation of powers issue. Democrats are just trying to stonewall and obstruct Estrada any way they can. They claim that Bush is trying to stack the court with conservative ideologues - but that's what they're doing. Judge Starr mentioned to me that GOP senators rubberstamped Clinton's judicial nominees, because they figured he'd won the election. The Democrats don't see it that way; they're playing hardball.

It's 100% B.S. to claim Estrada is "withholding" evidence. They did not seek any further answers at the end of his hearing in written form, which is the usual way to get answers on judges. Chuck Schumer didn't even bother to ask Estrada a single question - yet he's the one screaming the loudest that the guy's a "stealth candidate." If the Democrats are going to tie up this nomination, if they want to do it through filibustering everything and even side with Germany and France on appeasing our enemies in the war on terrorism, well, let's do the same thing.

The Democrats are terrified of Estrada because he's up for this lifetime appointment to the D.C. Circuit Court of Appeals - and that's the court that reviews congressional actions. Liberals live in abject fear of a conservative judge on that court, one who applies the law as written instead of "legislating from the bench." They are terrified by a limited government - which means they're doing all of this to keep you from having an advocate for your personal freedom and liberty. When you know this, their rabid opposition of this historic Hispanic nominee becomes crystal clear.

My favorite part is the idea that Estrada is not a "real" Hispanic. It reminds me of the Hermann Goering quote: "I decide who is a Jew and who is not."

Finally. Someone has explained in a short simple answer as to "why" the Democrats are filibustering. Thank you Mr. Limbaugh.

I have to admit that until Rush laid it out so succinctly, I didn't understand why the Dems were choosing this nominee to be the one they would wage all out war to stop.

Hope Rush hammers this point (the court that reviews congressional actions) home.

Well,Well,Well...I can think of a handful of National TV Commentators who aren't stating the truth about this issue,if they're mentioning it at all: Mr. Lemmings, Mr. Jokaw, Mr. Blather, Mr. Floppel, and I'll bet all of the other Alphabet Channels except perhaps Fox. This is the most recent and clear case of BIAS in the media.You can see why I don't the evening news.The next time someone mistakenly says/suggests there's no Bias in the media,I'm going to verbally fire this example at them, among the many others I have embedded in my brain.

FREEPers, I have created the ultimate Estrada activism thread. On it you will find ways to contact Senators, newsspapers, radio/tv people, organizations etc. Go there and help support Estrada. Keep the thread bumped until we get him confirmed.

Dear President Bush,
With the Surpeme Court session getting ready to close, it may well be time for perhaps the most important domestic decision of your presidency: the appointment of a Supreme Court Justice(s). The main reason why I supported you in 2000 and why I wanted Daschle out of power in 02 (and 04) has to do with the courts. I want America courts to interpret law, not write law. During your presidential campaign you said Thomas and Scalia were your two model justices. Those are excellent models. The High Court needs more like them. Clarence Thomas recently said to students that the tough cases were when what he wanted to do was different from what the law said. And he goes by the law. This should be a model philosophy for our justices. Your father, President Bush lost his reelection campaign for 3 main reasosn, as far as I can see. 1. he broke the no new taxes pledge 2. David Souter 3. Clinton convinced people we were in a Bush recession (which we had already come out of by the time Clinton was getting sworn in)

I urge you to learn from all three of these: 1. on taxes, you're doing great. Awesome job on the tax cut. 2. good job so far on judicial appointments. I want to see more of a fight for Estrada, Owen, and Pickering, but I commend you on your nominations. 3. by staying engaged in the economic debate you'll serve yourself well

I have been thoroughly impressed with your handling of al Queida, Iraq, and terrorism. You have inspired confidence and have shown great leadership.

But I want to remind you that your Supreme Court pick(s) will be with us LONG after you have departed office. I urge you to avoid the tempation to find a "compromise" pick. Go for a Scalia or Thomas. Don't go for an O'Connor or Kennedy. To be specific, get someone who is pro-life. Roe v Wade is one of the worst court decisions I know of, and it's the perfect example of unrestrained judicial power.

I know the temptation will be tremendous on you to nominate a moderate. But remember who your true supporters are. I am not a important leader or politician. I am "simply" a citizen who has been an enthusiatic supporter of you. I am willing to accept compromise in many areas of government but I will watch your Court nomiantions extremely closely. What the Senate Dems are doing right now is disgusting, but as the President you have the bully pulpit to stop it. Democrats will back down if you turn up serious heat on them.

Moreover, I think public opinion is shifting towards the pro-life position. Dems will want you to nominate a moderate, but almost all will vote against you anyways. Pro-choice Repubs will likely still vote for you if you nominate a Scalia, after all, you campaigned on it. So Mr. President, I urge you to stick with your campaign statements and nominate justices who believe in judicial restraint, like Scalia and Thomas.
