In perhaps its most forceful effort yet to break the stalemate over the appeals-court nomination of Miguel Estrada, the White House has now invited every member of the Senate who has doubts about Estrada's legal views to submit written questions to Estrada by the close of business Friday. In a letter delivered Thursday to all 100 senators, White House Counsel Alberto Gonzales said Estrada will respond by next Tuesday.

Here's my plan...The Senate is on recess next week. Start the War in Iraq this weekend, come out Monday and say that we can no longer afford to have the Senate tied up in partisan politics while a war is raging, and appoint Estrada by recess appointment (one year) Then bring his appointment up again next year when it is only 9 months before the election.

You will have established a oneyear record on Estrada.

The Dems right now think this obstruction will be forgotten because it's still almost two years til the next election...this will change that.

It will be impossible to argue that Estrada is not suited for a positino he has already held for a year.

Listen, it is time to call this what it is, RACISM! They could care less about the Constitution or Senate procedure. When this becomes a who is being racist argument then the Rats will feel the heat. They are keeping a Wetback on the Lettuce Farm and working next to the blacks on the Plantation. This is the worst form of Demoracism.

One indication is that they haven't made the RATs do a real filibuster.


How do you do this? I've asked TLBSHOW as that's his big thing is that they should be made to talk 24/7.... My question is how do you do this if they don't want to talk? I know of no rules in the Senate that can force someone or group to talk 24/7....

I've asked you several times on various threads just how you make the democrats talk/debate if they don't want to when they have 41+ votes at this time?

I'll answer that question for you.

The bill will come to the floor when scheduled, at that time, each Senator who request a floor time will get it.

Unlike the House, there are no time limits on the Senate so each Senator can hold the floor as long as they want.

Before each Senator who has requested floor time has yeilded the floor, the only way to stop the debate is by a vote of cloture, which currently requires 60 votes.

Even if a vote of cloture is not possible, the Republicans can go ahead and start the debate process by scheduling the vote.

If each member who requests time on the floor has yielded the floor at least once, then a simple majority of 51 could end debate and the vote would be taken.

If the Republicans do this, the Democrats would be forced to "Filibuster" by continuing to speak and thus not yield the floor.

If all the Democrats refuse to take the floor, then the vote would be held. This is what "forces" them to talk, the fact that the vote will come up as soon as they stop talking.

I just heard on Rush's show that Fox News Story about a cloture vote is false. Rush heard from Orrin Hatch's office for one thing about it. So don't believe all that you hear in the media about this Estrada nomination including Fox.

Where did you get that? The next scheduled recess is Easter.... Apr. 14 - 25.....

They are scheduled to take up the Estrada nomination again on Monday, Mar. 3rd at Noon,

Some of us were talking last night that the Fox Story was wrong about a vote. I thought Major Garrett had it totally wrong as he didn't even get what happened Wenesday night's vote right. It was only a Quorum Call not a vote to end debate.

I finally got sick and tired of the naysayers on that thread and got off the computer.

Rush just had a call from Hatch and he says that the fox story is not correct and there is no vote for Tuesday and that to have a real filibuster like the past can't happen because the senate changed the rules about 20 years ago? Anyone know about that one?

The battle does go on we are told.....

that is good news....I hope!

Oh and Rick's office called Rush too!

So I was wrong and the fox story was wrong where I based my thoughts on this from this.

Good...I was listening to Rush on my way to pick up a sammich. He was livid.

Let's see, Jeffords betrays Vermont and the rest of us and Daschle then requires a 60 vote super majority to bring anything to the senate floor. We got crap for a year.

Now, Pubbies are in control with a new shining SML and yet the Dems are still controlling the process from a minority over judicial appointments (and I guess anything else that can be filibustered)

What's wrong with this picture? Do we have to have a supermajority to pass anything?

I thought the Lott coup was supposed to change all this.

Why don't we play as tuff? I'll bet dollars to donuts Jeffords is still getting his dairy payoff.

Can Bush recess appoint Estrada?

If we lose this then the Dems will dictate the judciary from the minority.

I have to give them grudging credit...unlike us...THEY PLAY TO WIN!

Since that article from Fox News, Major Garrett, on Estrada's nomination turned out to be wrong -- there is no vote scheduled as both Hatch's and Santorum's offices called Rush, do you think some people on here might rethink their negativism from last night? Probably not?

One thing I would hope that people on here realize is that Fox News is made up of reporters that used to be on CNN and MSNBC and sometimes their facts are not correct. Fox is not infallible and people need to quit taking everything they say as 100% fact!

All you had to do was get to the 2nd paragraph of Garrett's article to know he wasn't telling the facts.

It is a ray of sunshine. I read that Garrett article last night and starting at the 2nd paragraph I knew it was wrong but the way Freepers went after it as fact I gave up!

Heard this on Rush but I was in my car! I couldn't wait to get back on here to see if someone posted it!
