I'm really glad Rush clarified this. Last week he seemed to think a cloture vote was the end of it if the Republicans lost. (I was getting quite confused between the rules re filibusters, the confusion re the Fox story, etc.) He clarified today what I'd originally been thinking -- *if* the Republicans lose the cloture vote, that means the "real" filibuster starts, do I have that right? And it's only going to end after that if the Democrats cave on their filibuster, is that right? To me it seems like a "can't lose" prospect if the Republicans are set to hang in there and force the Democrats to repeatedly put their names on their votes.

It could also end if the Republicans cave and drop the issue of Estrada.

Yes, but when Republicans try using them, the Democrats will bash them for "going negative," not "moving on," and that it's "old news."

I also think there is some license being taken with 'terms' by many in the media which further confuses the issue.

After a successful cloture vote (60 vote 'aye') the matter at hand becomes the SOLE matter and business of the Senate, until the matter is concluded. So, invoking cloture radically changes the dynamic. Asking for cloture does not cause this change, only if 60 Senators approve to cloture vote.

Sam Waksal Pleads Guilty to Tax Evasion

NEW YORK (Reuters) - Samuel Waksal, the former ImClone Systems Inc. IMCL.O chief executive who is awaiting sentencing for insider trading, pleaded guilty to additional charges on Monday for evading taxes on art purchases.

Waksal, appearing in federal court in New York, pleaded guilty to conspiracy, wire fraud and evading $1.2 million in sales taxes on art.

Waksal was at the center of an insider-trading scandal that involved family and friends, including home decorating expert Martha Stewart. He allegedly told his daughter and father that ImClone's experimental cancer drug would be rejected by U.S. regulators before the company released the information, causing the stock to plummet.

Yes. The "real" debate starts with a failed cloture vote and it continues until either (1) 60 Senators vote for cloture or (2) the Republicans decide they will never get the 60 votes, so they pull the nomination from the floor with no up or down vote being taken.

Waksal attorney Mark Pomerantz said his client has talked with the government about ``securities trading conduct by other people'' but stressed that he did not mean to imply Waksal had spoken about Stewart.
