I have not heard Frist say it will be a cloture petition tomorrow, but a couple of things make me think it will happen. I will wager that the reporter in this case had more than the 8-ball to go on. I predict the petition will be filed tomorrow.

It is going to be an interesting next two weeks.

The R's are going to fight his filibuster right
up to the war. They will have on record the rats
who are against this more then qualified
nominee.

I think they allowed morn business to continue
because they are about to slam the PBA bill
in their face, and do not want to be seen as unfair!

Sorry, my brain does not recall for sure. I am almost positive that it was Frist I saw at a microphone.
When they adjourned last week - he said that calling for the vote for cloture on Tuesday was a step he was reluctant to take but might have to do.

P.S. My sense is the same as yours, no cloture motion tomorrow. But, if it does happen, it will surprise the DEMs, because the GOP has not telegraphed any such intention, nevermind timing.

Good memeory. He might have said that. I know the GOP is reluctant to file a cloture motion, and I respect and understand the reluctance. I also sense, as you intimated, that the GOP is willing to go that route, if pressed. My sense is that the GOP is trying to force a vote with behind the scenes activity between Senators, and overt activity in the form of advertisments, letters from President Bush, etc. Also, winning points as the DEMs make total boobs of themselves (heheheh - he said "boobs").

My bottom line guess, cloture motion no sooner than Thursday noon, just before weekend recess.

Surrender is the final act, and in Estrada's case, is signaled when the GOP pulls the matter off the floor, but not before

Unless they go 24/7 after the a failing cloture vote they will be pulling from the floor.

I fully understand what you are saying about not backing down. None other than Bill Clinton has much to teach us about the importance of not giving up.

The problem that FOX News, Rush, and countless others have to overcome is that they all accept what I call the "and then you quit" philosophy. Such as, if you finish third in the New Hampshire primaries, then you quit. Bill Clinton said "No way, I'm not quitting, I don't care if I came in #121 after the county dog catcher." Or the rule that if you get caught in seemy extra-marital relationships, then just like Gary Hart, you quit. But Bill Clinton said "I'm not quitting, I don't care how many adulteries, rapes, etc. I stand creditably accused of, I AM NOT QUITTING. Even after being impeached under circumstances when no one could be expected to do anything other than quit, BC made it clear that come what may, HE WOULD NEVER QUIT.

Rush and FOX seem to have assumed that, if you lose a cloture vote, well then of course, YOU QUIT. Therefore, if you call for a cloture vote that you are bound to lose, then you are CAVING IN. That's absurd. A failure to achieve cloture only means that you continue to fight. You continue to shellack the opposition in every way so that, even if you find yourself losing at some future point on the nomination, you so damage the opposition that they may will think that any more "victories" like this will cost them the "war."

Time will tell how this plays out.
I believe the spectrum of options is a bit more varied than that (after failed cloture, either 24/7 sessions (on what subjects?) or pull the nomination).

Democrats are like elementary school bullies: they seemed invincible and tough when Republicans were frightened nerds who wouldn't face them, but now that the GOP is getting back in their faces I think they'll fold, like most bullies do. They're cowards inside...
