This falls under scandal. Civil homosexual "marriage" is tantamount to a public announcement that one is engaging in sodomy. So besides renouncing and confessing sodomy itself, the penitent has to "publicly declare" his renunciation of sodomy, by abrogating his civil "marriage."

In my experience the Catholic Church has many members in the church, but not in the Church. And their criticism can be Angry and judgemental Thus rendering the Biblical to process unlikely.
