SAN FRANCISCO, Calif. – The Supreme Court of California has unanimously voted to ban judges in the state from working with groups such as the Boy Scouts of America due to their stance on homosexual behavior.

The court voted on the matter on Friday, taking up a recommendation from the court’s Advisory Committee on the Code of Judicial Ethics.

How does this square with the right of association guaranteed by the Bill of Rights?

You can’t do this. It’s illegal.

More importantly, what does the decision mean? Is it merely advisory or can a judge be removed from office for working with the Boy Scouts?

There was an article posted earlier today in which Ann Barnhardt listed the stages we were all expected to go through as homosexuals push their cause:

Tolerance, acceptance, ratification, cooperation, participation.

As Ann points out, "participation" may seem surprising/unlikely -- but she defended the statement well. And we see here another example: working with the Boy Scouts will be frowned upon -- thus, for professional advancement, one will be forced to volunteer ONLY with groups that actively support homosexuals. THAT'S participation.

This strikes me as a violation of the right to peacefully assmble (1st amendment) and is very close to violating Article VI paragraph 3 (no religious test):

The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the United States.

The Supreme Court of California just eliminated freedom of opinion for judges in the state. Is it possible to have freedom of speech without freedom of opinion?
