June 6, 2017 (LifeSiteNews) — A federal district judge yesterday dismissed a leftist lawsuit against Christian pro-family advocate Scott Lively, who was sued for “crimes against humanity” for helping political and faith leaders in Uganda resist the LGBTQ agenda in the east African nation.
Massachusetts District Judge Michael Ponsor, in a ruling laced with harsh pro-homosexual attacks on Lively, nevertheless dismissed the SMUG (Sexual Minorities Uganda) LGBT lawsuit against Lively — five years after it was filed with the help of the far-left Center for Constitutional Rights (CCR).
Ponsor cited a 2013 (unanimous) U.S. Supreme Court ruling that the Alien Tort Statute did not apply to international claims as the reason for dismissing the lawsuit.
The Christian-defense legal group assisting Lively, Liberty Counsel, heralded the ruling but chastised Ponsor for failing to dismiss the case earlier and for lacing his decision with extremist, pro-LGBT rhetoric demonizing Lively and distorting his record.
“This is a victory for the Constitution and the rule of law,” said Mat Staver, Liberty Counsel’s founder and chairman, “and all Christians should celebrate the end of a lawsuit intended only to intimidate an innocent pastor into silence.”

Especially for frivolous suits designed to do nothing but shut down an opponent and cause a chilling effect on everyone else.
Some federal judges take a dim view of frivolous lawsuits. I have heard of plaintiffs being jailed for contempt of court and their lawyers being disbarred for bringing such suits into federal court.
Homo judge?
There is not a description of Massachusetts District Judge Michael Ponsor that could be considered to be too obscene.
Homosexual acts should still be illegal. If they were these perverts wouldn’t be running amuck.
The opinion seems to be only halfway based on the law and half on this judge’s personal and political views. But it’s Massachusetts, so...

Know Scott from years past in Oregon. He is an absolute trooper for Pro-Family causes and is a hero in my book. Moreover, he is one smart cookie.
Not everyone who wins a lawsuit should have. I agree there needs to be reform but loser pays has the potential to punish and bankrupt innocent parties
Innocent parties are usually losing because big guns are against them.
If you know you are in the right- and that the loser will eventually pay, then you can go all out.
I agree that SOMETIMES innocent people can be harmed by the best of intentions- but we would never get anything accomplished if we always wait for perfection.
He should now file suite against SMUG, CCR and the judge.
Thank heavens for Liberty Counsel or Lively would have been crushed by legal fees.
