Response to Police Questions on Wallet Card

This is the text of the Wallet card to carry with you. If you are stopped by the police, you are to read the card to them, so that you can testify in court that you did so. This technique has been very successful with the Miranda warning, so the courts are familiar with it.

THE TEXT ON THE CARD IS PRINTED BELOW

I refuse to consent to any search whatsoever. As such, I do not consent to a search of my premises, my person, my immediate location or any vehicle or effects. I hareby exercise my rights as enumerated by the Fourth, Fifth, Sixth, Ninth and Fourteenth Amendments to the United States Constitution as well as Article Two of the Arizona Constitution. I demand to have my attorney present prior to and throughout any questioning at all. Additionally, I wish to consult with my attorney prior to any discussion with law enforcement officers on the subject of waiver.

This is the card that I mentioned in the last article, DON'T BE YOUR OWN WORST ENEMY. I finally found the text. Many people had asked for it, so here it is. The original context that I heard about it was, What do you tell a policeman who asks if you have a gun in your car? Marc Victor told me that you do not have to say anything. You can remain silent.

Do you suggest that this card be distributed by our embassies and consulates abroad to applicants for visas to the US?

What if the LEO just asks for your license? Do you consider THAT a search?

great. and you feel comfortable with the knowledge that terrorists can use this line, too? i have very little to hide from our government, and resent the fact that MY freedom has been squelched by terrorists and ne'er-do-wells who abuse our Constitution.

Yes you can remain silent,refuse breathalyzers,etc.,etc.,just remember you better have money for a good lawyer because there will be consequences .

I never understand legal terms like "hareby".

Not always. If the penalites in your state are less for refusing than being convicted of a DWI, you might be better off refusing. But you have to know this ahead of time. Of course, if your state has the power to order you to the hospital and have blood extracted for a test, then you might as well bend over and blow.

The terrorists are not American citizens. Our Constitutional rights do not extend to foreign nationals on our soil.

Refuse to blow, refuse the field test but offer a blood test with your attorney present. Let them take you in, when they send in their medic say you'll only agree to a blood test taken by your personal family physician. When court time comes, you've been very cooperative and they won't have a blood test or any proof other than video. Answer no questions without your attorney present.

The charge is "driving while impaired" for a reason. I know a guy who blew a .02 and got a DWI. He was zoned out on cold medicine and drank a beer on top of that. If they take you to the hospital, you will have to take the test on the spot. and the blood will show a higher level than the breath test.

A wise lawyer once told me to blow. You can get a restricted license that allow you just about anything.

Yes, those are some of the rights which people when stopped by police. It may not help, depending on the circumstances the officer may may legal justification to do a great deal. One thing is for sure, you sure are going to make him suspicious. Perhaps suspicious enough to spend alot of time with you. I suggest waiting to "whip it out" until there appears to be some reason that is more than an speeding ticket.
