Pound sand Judge Ito.
Abraham Lincoln said: “ The best way to get rid of a bad law is to enforce it vigorously “
Progressive democrats say: “ The Best way to get rid of a Law you don’t agree with is to shop it to a Sympathetic court “
We should be asking Dems why they are anti-Lincoln?
Derrick got Schlonged!
I'm confused. I thought this decision stopped the Hawaii judge's family definition expansion and allowed the Administration to proceed with the narrower definition pending SC action? No?
I am sure Obama has a few more judges he appointed in Hawaii that can issue unconstitutional rulings from the bench.
Nope. Upheld district court power to interpret the SCOTUS order, and applied the District court's interpretation of "close relatives."
The Government's motion seeking clarification of our order of June 26, 2017, is denied. The District Court order modifying the preliminary injunction with respect to refugees covered by a formal assurance is stayed pending resolution of the Government's appeal to the Court of Appeals for the Ninth Circuit.Justice Thomas, Justice Alito, and Justice Gorsuch would have stayed the District Court order in its entirety.
Case 16-1540: July 18, 2017 SCOTUS Order
This case will now be heard in the 9th Circuit, which will deal only with the refugee part of the order. I expect the 9th Circuit to uphold the district court order in that regard, at which point the case comes back to SCOTUS.
The Hawaii judge made 2 rulings.
1). Expanded definition of family relationship to grandparents, aunts, uncles, etc. The SCOTUS decision today does not affect the expanded definition.
2). Hawaii judge also expanded the number people who could come into the US (some existing relationship with refugee resettlement orgs). SCOTUS decision today over-ruled that expansion.
That is my understanding of todays decision.
Finally this guy can stop his bench activism for a while and maybe get on to some real work in Hawaii, like taking peoples guns away.
Bloomberg article has good description: https://www.bloomberg.com/news/articles/2017-07-19/trump-rejected-by-u-s-supreme-court-on-reach-of-travel-ban
That judge needs to be impeached. He is a very loose cannon. Excellent decision by the Supremes!
I remember a time when there was an execution scheduled, and a court kept issuing stays that kept getting shot down by the Supremes. After 3 or 4 times of that, the Supremes issued an order saying, “No more stays from you, lower court”.
We need another one of those orders to the 9th. No more TROs on immigration issues. Hear both sides, issue a judgment after trial, stay enforcement of your judgment, and then we’ll look at it.
Thanks.
Not good. We need another justice before this is decided, or it will create bad law that will be difficult to get rid of.
Good. If Trump accomplishes nothing else, he will have been worthwhile.
Didn't overrule it, said this had to back down for the appeal process. Either way, after the 9th Circuit rules on this, the case is coming back to SCOTUS.
I see this as a loss for the administration, and a win for the federal court system, which now appears to be in the business of setting immigration policy.
You haven't read the decision. SCOTUS upheld (for now) the major part of the Hawaii judge's order-- the part that expanded the definition of "close relatives" to include grandparents, grandchildren, aunts, uncles, etc.
Can someone clarify? ABC and Bloomberg #fakenews say Trump lost but the way I read the release it says the Hawaii punk’s order is STAYED pending Trump’s appeal to Ninth Circuit.
Sessions said he's prepared for the next USSC court battle.
I wonder if the State Department will now un-expand their definition. I hope so, because "cousin" can be pretty broad and a lot of people can slip through based on being someone's cousin.
