It's useless to engage the apologists on the Finicum matter.
All you can do it post the facts.
- Unknown persons fired a shot at Finicum's truck when HE STOPPED the first time. He was NOT "stopped".
- Finicum was driving down the road to seek a REAL law enforcement official, instead of geared-up triggerhappy camo gunthugs. He was driving at normal highway speeds.
- The roadblock was set up around a blind curve, incorrectly. Finicum immediately braked upon seeing the unidentified vehicles completely blocking the road, but took to the snowbank upon realizing that he wouldn't be able to stop.
- The "law enforcement officers", to use the term loosely, immediately took Finicum's truck under fire, as noted by freeper EternalVigilance in post #100.
- An fbi sniper attempted to shoot Finicum through the driver's side passenger window, as he bounded out of the truck as it stopped, with his hands raised. This was captured on the in-truck cellphone video - you can see the window glass shattering. The fbi sniper and his fbi friends attempted to cover up these shots, but were found out by HONEST law enforcement - the Deschutes County Sheriff and his people.
- Since Finicum had his hands raised while being shot at, any contention that he "was going for a weapon" can be dismissed out of hand.
- The "law enforcement" people still have not released any audio of the shooting. They'll have trouble with the audio of the cellphone video. Somewhere, God is smiling. :)
As we can see, the apologists don't deal in facts. They deal in their emotional investment in the case.
So, we needn't deal with them. :)
Footnote:
Here are the Supreme Court cases dealing with roadblocks (a "seizure" under the Fourth Amendment):
> Brower v. County of Inyo
> City of Canton, Ohio v. Harris
> Tennessee v. Garner
A quote from a discussion paper from the DOJ:
Fixed roadblocks, which block road to extent that little or no outlet remains.
"Fixed roadblocks are extremely dangerous and are rarely justifiable."
They set up around a blind curve. It's not going to go well for them in civil court. :)
