When did parents stop teaching their children to keep their hands off stuff that doesn’t belong to them? A little slap on the hand and a strict admonishment at an early age is how it’s done. We have a problem in my family with a 9 year old that was never taught this simple lesson and now everywhere he goes he screws up people’s high end AV equipment, computers, cell phones and office equipment because he was never taught to keep his hands to himself. Having children involves responsibility. If you don’t want to watch your child leave them at home with a baby sitter.

I’d wager a counter-suit saying the establishment did not provide proper protections for the sculpture or for the potential danger to children that might come into contact with it....parents should also keep a better watch at what their kids are doing....in the auto-accident jargon, it’s considered contributive negligence ... bit different here but similar.

You have made many good points. Most of them would fall under the laws pertaining to maintaining an attractive nuisance. I dont think the venue will stand chance of a successful law suit. As no protective measures were taken a judge could rule that the venue was 100% responsible for the damage.

You know I’m taking both sides of this argument. Really!

That “Art” and I use that word loosely, should have been roped off, under plexiglass or just in the dumpster. Had that fallen by accident or on purpose on him or any kid in there it could have hurt/killed him. I agree it should not have been so easy to access.

On the other hand this is where I’m gonna give the wisdom of my Grandmother. She always complained of young mothers who brought over their 2 year olds and the moms would set every thing (kick knacks, what nots and other stuff in reach of the brat on tables) that could hurt them or the kid could break out of reach. My grandmother said “no” you don’t do that. If the kid reaches for something that does not belong to him/her you smack his/her hand and tell him “no”. You train him/her that does not belong to you and you are not to touch it.

Well that is what these parents should have done and we can all tell did not do. That “thing” did not belong to that kid and he should not have been touching it. He did now it’s broke. Maybe in the future his rotten parents will teach him not to touch stuff that does not belong to him.
