I agree, completely.
The problem is that tests for cannabis and nicotine only show whether or not you’ve used it in the last several days or weeks.
If you don’t nip this thing on the bud, soon everyone will be doing it. Like when they say “If you don’t want to live in an HOA, don’t buy in one.”. Ok, where? Demanding free work, which is how this should be viewed, is illegal.

No they won't........Group health insurance rates have nothing to do with the personal habits of an employer's employees.

A private company has the right to do that and there are companies that do exactly that.

Are there any other employment regulations and laws that you want the government to force on private companies?
They have to prove that there is a legitimate business reason for restricting the employee’s weight.
For example: being part of an aircraft crew.
But you do agree that U-Haul has the right to their own employment policies?
Interesting. I thought that I had just heard (some podcast probably) that nicotine by itself, though addictive, did not pose a health risk.
Smoking obviously does.
Chewing tobacco can.

As a subcontractor on government funded construction projects I am often forced to hire minorities. I don’t want to hire someone based on their skin color but they say I must.
I don’t see any 400 pound fighter pilots and don’t see any 350 pound supermodels.

I agree. In the course of human history, alcohol use goes back tens of millennia, but nicotine use only goes back 500 years to the time of Columbus; the natives he & other explorers encountered were using tobacco, and this found its way back to Europe.
Cheeseburger affidavits are unnecessary; just make all employees weigh in on a regular basis since those who are overweight drive up company medical costs, which as you say affects each employee’s insurance premiums.

Agreed... but laws themselves, ALL laws, discriminate. That is how laws work. And to inhibit free-will discrimination of ANY kind is counter/repugnant against the rights GUARANTEED to every individual by the constitution... God given natural inalienable rights.
These rights include the right to free association, free will, free choice, right to your labor/property, right to freely discriminate and the right to choose personal destiny. Which applies equally to any party, group, association or business.
No laws can abridge those rights unless your free-exercising of certain rights are harmful to the free-exercise of someone else’s rights. Then laws must be in place to protect you from other individuals, groups, associations or businesses from making harmful choices. “There can be no freedom without the law.” - Moses
Women have no choice for being born a woman. Nicotine users make choices, lousy ones but it is their choice none the less.
